Resolution 12748CITY CF ALAMEDA RESOLUTION 12748 ADOPTING PENAL CODE SECTION 597.1 RELATING TO THE IMPOUNDING OF NEGLECTED AND ABANDONED ANIMALS WHEREAS, the provisions of Penal Code section 597(f) relating to the impounding of neglected and abandoned animals and placing a lien thereon has been declared unconstitutional; and WHEREAS, the legislature adopted Penal Code section 597.1 which provides for notice and hearing before imposing a lien and disposing of animals taken into custody by the City of Alameda; and WHEREAS, the City of Alameda has no effective method of dealing with sick and neglected animals taken into possession and maintained by the City; and WHEREAS, subdivision (1) of Penal Code section 597.1 is operative in any city which chooses to be governed by its provisions, in lieu of Penal Code section 597(f). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the provisions of Penal Code section 597.1 shall be operative in the City of Alameda and shall replace the provisions of Penal Code section 597(f). * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 19th day of March , 1996, by the following vote to wit: AYES: NOES: ABSENT: Councilmembers Arnerich, DeWitt, Lucas, Mannix and President Appezzato - 5.
