BE IT RESOLVED, by the Council of the City of Alameda
that pursuant to the provisions of Subsection 2 -12.2 of the Alameda
Municipal Code, and upon nomination of the Mayor, ROBERT RYAN is
hereby appointed to the office of Tenant Member of the Housing
Commission of the City of Alameda to fill the unexpired term of
Solomon Edwards, for a term commencing on May 8, 1996 and expiring
on June 30, 1996 and to serve until his successor is appointed and
qualified.

CITY OF ALAMEDA RESOLUTION NO. 12765
IMPOSING LIENS AND ESTABLISHING INTEREST RATES
ON AMOUNTS OWED BY PROPERTY OWNERS
WHO HAVE FAILED TO PAY SIDEWALK REPAIR ASSESSMENTS
WHEREAS, City of Alameda property owners are responsible
for sidewalk repairs unless damage is caused by City trees or
defective sanitary sewer pipes; and
WHEREAS, in accordance with California Streets and
Highway Code Section 5610, the City of Alameda can assess property
owners for sidewalk repairs, including interest; and
WHEREAS, the City of Alameda has an annual program to
identify and repair sidewalks; and
WHEREAS, in order to minimize the City's exposure to
l>.claims, sidewalk repairs must be performed in a timely manner; and
WHEREAS, if the property owner fails to either make
re c-ars or pay the City to make repairs within an allotted time
the City can assess the property owner for costs; and

WHEREAS, the City Council has determined that a six
-'percent (6.09s) annual interest rate be established for outstanding
assessments; and
WHEREAS, as of December, 1995, 3 property owners have
received notices both prior to repairs and subsequent to repairs;
and.
WHEREAS, the property owner has five (5) days from City
Council action to pay the City of Alameda before a lien notice is
filed with the County.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that the City Council accept the annual Sidewalk
Repair Report and imposes the liens and establishes six percent
(6.09s.) annual interest rate on amounts owed by property owners who
have failed to pay sidewalk repair assessments.

RESOLUTION OF INTENTION
TO LEVY AN ANNUAL ASSESSMENT ON THE
ALAMEDA BUSINESS IMPROVEMENT AREA
OF THE CITY OF ALAMEDA FOR FY 1996-97
AND SETTING PUBLIC HEARING FOR JUNE 4, 1996
WHEREAS, Section 6-7 of Article II of Chapter VI of the
Alameda Municipal Code establishes the Alameda Business Improvement
Area of the City of Alameda (hereinafter "Area"); and
WHEREAS, the Area comprises all of the Park Street
Business Area, included by reference on the map and list of
inclusive addresses included in this Resolution as Exhibit A and C,
respectively; and all of the Webster Street Business Area included
by reference on the map and list of inclusive addresses included in
this Resolution as Exhibit B and C, respectively; and
WHEREAS, the improvements and activities authorized by
the ordinance include the general promotion of business activities
in the Area, the promotion of the public events which are to take
place on or in public places in the Area, the decoration of any
public place in the Area, the furnishing of music in any public
place in the Area, and the acquisition, construction or maintenance
parking facilities for the benefit of the Area; and
WHEREAS, agreements between the City of Alameda
(hereinafter "City") and the Park Street Business Association
'al(hereinafter "PSBA") and the West Alameda Business Association
i(hereinafter "WABA") designated PSBA and. WABA to administer
usiness Improvement Area (hereinafter "BIA") funds for their
respective geographic zones of the BIA; and
WHEREAS, PSBA and WABA have filed reports with the City
Clerk describing the surplus or deficit revenues to be carried over
from FY 1995-96 and describing the improvements and activities,
estimated costs and method and basis for levying the assessment for
FY 1996-97.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that PSBA and WABA are hereby designated as the BIA
Advisory Body for 1996-97; and
BE IT FURTHER RESOLVED that the City Council hereby
declares its intention to levy and collect assessments within the
Alameda Parking and Business Improvement Area for FY 1996-97; and
BE IT FURTHER RESOLVED that the City Council hereby sets
a public hearing before the City Council at its regularly scheduled
meeting of June 4, 1996, at which time written and oral protests
may be made; and
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to advertise said public hearing by causing this
Resolution of Intention to be published once in a newspaper of
general circulation in the City not less than seven days before the
public hearing.

WHEREAS, on June 1, 1996, Americans from all backgrounds
will come together to take a "Stand For Children" at the Lincoln
Memorial in Washington, D.C., and renew our community's commitment
to improving the quality of our children's lives; and.
WHEREAS, on "Alameda Stand for Children Day" and beyond,
families, citizens, members of religious congregations, schools,
community-based organizations, businesses, and political and
cultural groups will join together as a local and national
community to recognize our children's unmet needs and rededicate
ourselves to addressing them; and.
WHEREAS, caring for our children must be our families',
community's, and nation's first priority; and
WHEREAS, this commitment must begin at the local level,
where children and families live and work and have the potential to
thrive, and where all citizens, working together, can make a
difference in our children's lives.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Alameda hereby designates June 1, 1996 as "ALAMEDA
STAND FOR CHILDREN DAY" and urge all citizens to support this day

PRELIMINARILY APPROVING ANNUAL REPORT DECLARING
INTENTION TO ORDER LEVY AND COLLECTION OF ASSESSMENTS
AND PROVIDING FOR NOTICE OF JULY 16,1996 HEARING
THEREOF - ISLAND CITY LANDSCAPING AND LIGHTING DISTRICT
84-2
WHEREAS, the City of Alameda (the "City") has duly
created the Island City Landscaping and Lighting District 84-2
(the "District") under the Landscaping and Lighting Act of 1972
(Sections 22500 and following of the Streets and Highways Code of
California) (the "Act") to install and maintain certain
landscaping and lighting improvements (the "Improvements"); and
WHEREAS, the City has directed the City Engineer, as
engineer of work for the District, to file an annual report in
accordance with the Landscaping and Lighting Act of 1972, and
that report is on file with the City and shows the proposed
improvements and the estimated costs and assessments, all for the
fiscal year 1996-7.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Alameda that:
1. The report of the engineer of work on file with the
City is hereby preliminarily approved and the City intends to
levy assessments on the properties shown in the report for the
fiscal year 1996-97, subject to any changes that may be ordered
by the Council.
2. On July 16, 1995, at the hour of 7:30 o'clock P.M.,
the Council will hold a public hearing on the proposed
Improvements and the proposed assessments for the fiscal year
1996-7. The hearing will be held at the meeting place of the
Council, in the Alameda High School Little Theater, 2200 Central
Avenue, Alameda, California, 94501.
3. The City Clerk is authorized and directed to give
notice of the hearing required by the Landscaping and Lighting
Act of 1972 by publishing a copy of this resolution twice in the
Alameda Journal, a newspaper published and circulated in the
City. The first publication shall be not later than 45 days
before the date of said hearing.
4. The Public Works Department is directed to mail
notices to all property owners who are experiencing an increase
in assessment from the 1995-96 fiscal year.
5. Interested persons should contact Marge McLean of
the City of Alameda Public Works Department, 2250 Central Avenue,
Alameda, California 94501, telephone number (510) 748-4651,
regarding this hearing, the assessments and the report.
