AMENDING MASTER FEE RESOLUTION NO. 12191
AUTHORIZING THE SETTING OF AN
ADMINISTRATIVE TOW FEE TO ESTABLISH A
"TRAFFIC OFFENDER FUND"
WHEREAS, the City has applied for and received grant
funding from the Office of Traffic Safety (OTS) to establish a
Drunk Driving Education and Enforcement Program that requires that
the City set an Administrative Tow Fee to establish a Traffic
Offender Fund that will be used to continue with the program after
grant funding has expired; and
WHEREAS, the City, through the Drunk Driving Education
and Enforcement Program, wishes to continue with the program after
grant funding expires to reduce injury and fatal traffic
collisions, increase street and highway safety, increase the public
awareness of traffic laws and traffic safety, and to apply training
materials for traffic safety, accident investigation and drunk
driving and to assist in the removal and prosecution of drivers
driving with a suspended or revoked drivers license; and
WHEREAS, the AJameda Municipal Code and the California
Government Code provide that the City Council may set fees for
reasonable cost of providing various services by resolution; and
WHEREAS, the City Council, at the August 27, 1991 Special
City Council meeting directed .City staff to amend the Alameda
Municipal Code to reflect that City fees shall be set by City
Council resolution; and
WHEREAS, Resolution No. 12191 ("Master Fee Resolution"),
as amended, codifies existing fees for various City services and
permits; and
WHEREAS, the City Council has determined that the
proposed Administrative Tow Fee is reasonable for providing
municipal services.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that said council endorses the setting of an
Administrative Tow Fee to establish a Traffic Offender Fund as set
forth in the OTS guidelines and Section 22850.6 of the California
Vehicle Code, to help perpetuate the Drunk Driving Education and
Enforcement Program at the expiration of grant funds.
ADMINISTRATIVE TOW FEE $100.00
BE IT FURTHER RESOLVED that pursuant to Ordinance No.
1928, the City fees are subject to administrative adjustments not
greater than 5% annually over the existing recovery levels.
BE IT FURTHER RESOLVED that all fees established by
Master Fee Resolution No. 12191 which are inconsistent with the fee
established by this resolution are hereby repealed.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 17th
day of December , 1996, by the following vote to wit:
