IMPOSING LIENS AND ESTABLISHING INTEREST RATES
ON AMOUNTS OWED BY PROPERTY OWNERS
WHO HAVE FAILED TO PAY SIDEWALK REPAIR ASSESSMENTS
WHEREAS, City of Alameda property owners are responsible for
sidewalk repairs unless damage is caused by City trees or defective
sanitary sewer pipes; and
WHEREAS, in accordance with California Streets and Highway
Code Section 5610, the City of Alameda can assess property owners
for sidewalk repairs, including interest; and
WHEREAS, the City of Alameda has an annual program to
identify and repair sidewalks; and
WHEREAS, in order to minimize the City's exposure to claims,
sidewalk repairs must be performed in a timely manner; and
WHEREAS, if the property owner fails to either make repairs or
pay the City to make repairs within an allotted time frame, the
City can assess the property owner for costs; and
WHEREAS, the City Council has determined that a six percent
(6.096) annual interest rate be established for outstanding
assessments; and
WHEREAS, as of January, 1997, one(1) property owner received
notice both prior to repairs and subsequent to repairs; and
WHEREAS, the property owner has five (5) days from City
Council action to pay the City of Alameda before a lien notice is
filed with the County.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Alameda that the City Council accept the annual Sidewalk Repair
Report and imposes the liens and establishes six percent (6.0%-)
annual interest rate on amounts owed by property owners who have
failed to pay sidewalk repair assessments.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and ,regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 17th
day of June , 1997, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas
and President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
