REJECTING ALL BIDS AND AUTHORIZING PUBLIC WORKS DIRECTOR TO
NEGOTIATE AND EXECUTE AN OPEN MARKET CONTRACT PURSUANT
TO CHARTER SECTION 3 -15 FOR MINOR STREET PATCHING WITH
ASPHALT CONCRETE
WHEREAS, on June 17, 1997, the Council of the City of Alameda adopted Plans and
Specifications and called for bids for Minor Street Patching with Asphalt Concrete for fiscal year
ending June 30, 1998, No. P.W. 06- 97 -13; and
WHEREAS, bid was opened on July 23, 1997, with one bid submitted, the bid submitted
exceeding the available project by $38,000; and
WHEREAS, City Council desires to reject all bids; and
WHEREAS, in accordance with Section 3 -15 of the City Charter, the Council may, by a
majority of (4) votes, determine that great necessity requires immediate action and thereupon
proceed to acquire a contractor in the open market to make the necessary repairs; and
WHEREAS, great necessity exists to repair potholes in streets and sidewalk lifts using
Asphalt Concrete (AC) fillet; and
WHEREAS, there are sufficient funds available to finance the proposed project; and
WHEREAS, the estimated cost of the project is $22,000.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that all
bids are rejected and pursuant to Section 3 -15 of the City Charter, and by four (4) affirmative votes,
the City Council hereby authorizes the Public Works Director and/or his authorized representatives
to negotiate and execute an open market contract for emergency potholes and AC fillets sidewalk
repair at the all - inclusive cost of $22,000, without formal bidding procedures.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 19th
day of August , 1997, by the following vote to wit:
AYES: Councilmembers Daysog, Kerr, Lucas and
Acting President DeWitt - 4.
NOES: None.
ABSENT: Mayor Appezzato - 1.
ABSTENTIONS: None.
