ELECTING TO RECEIVE ALL OR A PORTION OF THE TAX REVENUES
PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33607.5 AND 33676.
WHEREAS, the Community Improvement Commission of the City of Alameda
(the "CIC") is preparing a proposed redevelopment plan (the "Community
Improvement Plan") for the proposed Alameda Point Improvement Project
(the "Project"); and
WHEREAS, for redevelopment plans adopted on or after January 1,
1994, Section 33607.5 of the California Community Redevelopment Law
(Health and Safety Code Section 33000 et seq.) provides that in any
fiscal year in which a redevelopment agency receives tax increments, the
community that has adopted the redevelopment project area may elect to
receive, and the agency shall pay to it, an amount equal to 25 percent
of its proportionate share of the tax increments received by the agency
after the amount required to be deposited in the Low and Moderate Income
Housing Fund has been deducted (the "City Election"); and
WHEREAS, Section 33676 of the Community Redevelopment Law provides

*-4------ the Community Redevelopment Law, all or any portion of the tax revenues
allocated to the Agency from the Project Area pursuant to Section
33670(b) of the Community Redevelopment Law which are attributable to the
tax rate increases imposed for the benefit of the taxing agency after the
tax year in which the ordinance adopting the redevelopment plan becomes
effective (the "Increases"); and
WHEREAS, the City Council of the City of Alameda (the "City
Council") desires to make the City Election and receive the Increases.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda that:
Section 1. The Council hereby elects to receive the City Election
and all Increases, as herein defined, resulting from taxes levied on
property within the Project Area.
Section 2. The City Clerk is hereby directed and authorized to
transmit a copy of this Resolution to the Executive Director of the CIC
of the City of Alameda and to the tax collector of Alameda County.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the Council
of the City of Alameda in regular meeting assembled on the 16th
day of December , 1997, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas
and President Appezzato - 5.
NOES: None.
ABSENT: None
ABSTENTIONS: None.
