FINDING AND DETERMINING THAT THE PUBLIC INTEREST,
NECESSITY AND CONVENIENCE REQUIRE THE CONSTRUCTION OF THE
PROJECT, AUTHORIZING ACQUISITION OF REAL PROPERTY BY
CONDEMNATION, AND FINDING THAT AN OFFER OF JUST
COMPENSATION HAS BEEN MADE (ASSESSOR'S PARCEL NUMBERS
074 - 0905 -023 (ALL) AND 025 -3 (PORTION), PROPERTY LOCATED
ON THE EASTERLY SIDE OF MAIN STREET BETWEEN ATLANTIC
AVENUE AND SINGLETON AVENUE, ALAMEDA)
WHEREAS, the City of Alameda is authorized to construct the
additions and improvements to the City's Main Street Linear
Park /Greenway; and
WHEREAS, the City cf Alameda is authorized to acquire property
by eminent domain pursuant to law, including the Eminent Domain
Law, sections 1245.210 et seq., and Government Code section
37350.5; and
WHEREAS, the acquisition of property and rights in property is
necessary to order to construct the project in the public interest;
and
WHEREAS, the City Council had, heard and considered evidence
relating to the project, the proposed acquisition, and the public
interest, necessity and convenience.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Alameda as follows:
1. That the City Council finds and determines each of the
following:
(a) That the public interest and necessity require the
proposed project;
(b) That the proposed project is planned and located in
the manner that will be the most compatible with
the greatest public good and the least private
injury;
(c) The property described in the resolution is
necessary for the project; and
(d) That the offer required by section 7267.2 of the
Government Code has been made to the owner or
owners of record.
2. That the acquisition is permitted by law.
3. That the property to be acquired is generally known as
Assessor's Parcel Numbers 074- 0905 -023 (All) and 025 -3
( Portion), Property Located on the Easterly Side of Main
Street between Atlantic Avenue and Singleton Avenue,
Alameda.
4. That the City Attorney, Special _Counsel, City Manager,
and staff are authorized and directed to take such steps
and actions, and to file such legal proceedings, as may
be necessary to acquire the property and to obtain an
Order of Immediate Possession.
1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in regular meeting assembled on
the 7th day of July , 1998, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Kerr, Lucas and
President Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
