APPROVING THE UNDERTAKING OF CERTAIN
PUBLIC IMPROVEMENTS ON BEHALF OF
THE COMMUNITY IMPROVEMENT COMMISSION
WHEREAS, the Community Improvement Commission of the City of
Alameda (the "CIC") is carrying out the Community Improvement Plan
of the Business and Waterfront Improvement Project (the "BWIP");
and
WHEREAS, Section 33445 of the Community Redevelopment Law
(Health and Safety Code section 33000 et seq.) provides that the
CIC may, with the City Council of the City of Alameda's (the
"Council") consent, pay for all or part of the value of the land
for and the cost of the installation and construction of any
building, facility, structure or other improvements that are
publicly owned either within or outside the boundaries of the BWIP
if the CIC and the Council make certain findings; and
WHEREAS, Section 318 of the Community Improvement Plan
authorizes the CIC to install and construct public improvements
within the BWIP Area; and :0

WHEREAS, these types of Improvements were included in the CIC<
Implementation Plan adopted December 6, 1994 pursuant to Health and 1
Safety Code Section 33490; and
WHEREAS, the CIC wishes the City to make drainage and greenway
improvements to Main Street between Atlantic Avenue and Singleton
Avenue, to provide safe and efficient traffic flow and public
amenities (the "Improvements").
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALAMEDA DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Council hereby finds and determines that the
drainage and greenway improvements to Main Street between Atlantic
Avenue and Singleton Avenue are of benefit to the Project Area and
the immediate neighborhood in which the Project is located, and
that no other reasonable means of financing the Improvements are
available to the community. The following facts support this
finding:
(A) This area of Main Street currently floods during
heavy rains;
(B) The property adjacent to this area of Main Street
is not landscaped;
(C) The Improvements shall greatly improve the safety
and efficiency and appearance of this area of Main
Street, and therefore benefit the Project Area;
(D) The City does not have sufficient permanent funds
to undertake the Improvements.
Section 2. The Council hereby approves the undertaking by the
City of the Improvements based upon the agreement by the CIC to
reimburse the City for a portion of the costs of the Improvements.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in regular meeting assembled on
the 21st day of July , 1998, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Lucas and
President Appezzato - 4.
NOES: None.
ABSENT: Councilmember Kerr - 1.
ABSTENTIONS: None.
