AUTHORIZING THE CITY MANAGER TO EXECUTE THE JOINT POWERS
AGREEMENT CREATING A.B.A.G. POWER AND THE NATURAL GAS
SALES AND AGGREGATION AGREEMENT FOR FISCAL YEAR 1998 -99 AND
APPOINTING A CITY REPRESENTATIVE TO A.B.A.G. POWER AS THE
CORE TRANSPORT AGENT FOR THE CITY OF ALAMEDA IN PROCURING
THE PURCHASE AND TRANSPORTATION OF NATURAL GAS AND
RELATED SERVICES AND APPOINTING A CITY REPRESENTATIVE TO
THE A.B.A.G. POWER BOARD OF DIRECTORS
WHEREAS, ABAG formed a Power Purchasing Pool Program to aggregate natural gas needs ,
of interested ABAG members and cooperating members in 1996 and currently acts as a core
transport agent on behalf of such members to deliver or cause to be delivered natural gas and related
services (including invoicing and gas management) to such members and has formed a Power
Purchasing Pool Committee comprised of representatives from each participating member or
cooperating member and grant it the power to oversee the Program; and
WHEREAS, the City of Alameda has contracted with the Association of Bay Area
Governments (ABAG) through the Power Purchasing Pool Program since fiscal year 1995 -96; and
WHEREAS, the Power Purchasing Program achieved savings (over the Pacific Gas &
Electric Company's (PG &E) natural gas tariff rates) of seven percent (7 %) in FY 1996 -97 and is
estimated to achieve five to six percent (5 -6 %) for 1997 -98; and
WHEREAS, ABAG and the City of Alameda along with other public entities in PG &E's
service territory formed a new joint powers agency, ABAG Publicly Owned Energy Resources
(ABAG POWER) which is staffed by ABAG to implement a program for the acquisition of electric
supply and related services (Electric Program) and to perform ABAG's function in the Power
Purchasing Pool Program (Natural Gas Program); and
WHEREAS, The executive Board of ABAG has authorized the transfer of the Power
Purchasing Program to ABAG POWER and assignment of all Natural Gas Sales and Aggregation
Agreements (Agreement) to ABAG POWER; and
WHEREAS, members of ABAG POWER may elect to participate in only the Natural Gas
or the Electric Programs, or both; and
WHEREAS, each participant in ABAG POWER will be represented on the Board of
Directors of ABAG POWER by a director, or in his/her absence by an alternate, appointed by the
participant; and
WHEREAS, the City of Alameda finds that it is in its best interest and the public interest to
join ABAG POWER and participate in the ABAG POWER Natural gas Program.
NOW, THEREFORE, BE IT RESOLVED, that the City of Alameda of the County of
Alameda hereby (1) authorizes' the execution and delivery of the Joint Powers Agreement creating
ABAG POWER and (2) authorizes the execution and delivery of the Natural gas Sales and
Aggregation Agreement for fiscal year 1998 -99 and appointing ABAG POWER as the core transport
agent for the Public Agency in procuring the purchase and transportation of natural gas and related
services and the Utility's Customer Authorization for Core Gas Transportation Services.
BE IT FURTHER RESOLVED, that the Administrative Management Analyst in Public
Works is appointed the City of Alameda's representative on the ABAG POWER Board of Directors
and the Administrative Services Coordinator in the Finance Department as her alternate.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in regular meeting assembled on the
4th day of August ,1998, by the following vote to wit:
