AUTHORIZING THE PUBLIC WORKS DIRECTOR TO
NEGOTIATE IN THE OPEN MARKET, PURSUANT TO
SECTION 3-15 OF THE CITY CHARTER, REMOVAL AND
DISMANTLEMENT OF TWO ELEVATED WATER TANKS,
ALAMEDA POINT, NO. P.W. 06-98-17
WHEREAS, the two elevated water tanks at Alameda Point are safety and health
hazards and need immediate removal; and
WHEREAS, the City must award the contract by September 30, 1998, in order to
use the 1997/98 funding from the Navy Caretaker Agreement budget; and
WHEREAS, open market negotiation is suggested to complete construction of the
project because there is insufficient time to undertake formal bids in order to award the contract
which will otherwise be unfunded; and
WHEREAS, in accordance with Section 3-15 of the City Charter, the Council may,
by four (4) votes, determine that great necessity or emergency requires immediate action and
thereupon proceed to acquire a contractor in the open market to make necessary repairs.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda,
that pursuant to Section 3-15 of the City Charter, the City Council hereby finds that there is great
necessity to remove the storage tanks immediately as they present a health and safety hazard and
because funding for the project will otherwise expire on September 30, 1998, the City Council
hereby authorizes the Public Works Director and/or his authorized representatives to enter into
an open market contract for the removal and dismantlement of two elevated water tanks at
Alameda Point subject to Navy approval of these funds.

adopted and passed by the Council of the City of Alameda in regular meeting assembled on
the 15th day of September , 1998, by the following vote to wit:
