Resolution 13111CITY OF ALAMEDA RESOLUTION NO. 13111 SUPPORTING COMPLETION OF THE EBMUD AMENDATORY CONTRACT WITH THE UNITED STATES BUREAU OF RECLAMATION WHEREAS, water available from the East Bay Municipal Utility District's ( EBMUD) high - quality Sierra source, the Mokelumne River, is limited and EBMUD forecasts that in three out of ten years, customers will face water rationing; and WHEREAS, EBMUD completed in 1993 a comprehensive Integrated Resource Management Plan that exhaustively evaluated all feasible methods for reducing the need for additional water supplies and alternatives for providing such additional supply; and WHEREAS, EBMUD has taken the important necessary steps to reduce its water demand through aggressive water conservation with methods such as metering, tiered rates, low flush toilet replacement programs and water reclamation programs; and WHEREAS, consistent with this planning, the City of Alameda recognizes the critical need of communities within the EBMUD service area for a supplemental water supply; and WHEREAS, EBMUD has held and paid for its American River contract rights for more than 25 years with those rights affirmed through the courts, and those rights specifically provide for the protection of recreation and wildlife habitat; and WHEREAS, EBMUD has sought a joint project with parties in the Sacramento region to cooperatively use and protect American River resources even though the majority of Sacramento water users have not metered their water use and WHEREAS. EBMUD customer have a long record of commitment to sensible water use and EBMUD continues to invest in reclamation and conversation. NOW, THEREFORE, BE IT RESOLVED that the City of Alameda supports completion of the EBMUD Amendatory Contract with the United States Bureau of Reclamation. This Amendatory Contract provides for near -term access to EBMUD's long -held rights to American River water either as a District -only project or as part of a joint project that provides benefits to the largest community of interest possible. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to forward a Certified Copy of this resolution to EBMUD and to the U.S. Secretary of the Department of Interior. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 15th day of June , 1999, by the following vote to wit: AYES: Councilmembers DeWitt, Johnson, Kerr and Acting Mayor Daysog - 4.
