AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION TO
THE SECRETARY OF THE UNITED STATES DEPARTMENT OF THE
INTERIOR FOR A PUBLIC BENEFIT CONVEYANCE OF OPEN SPACE
AND RECREATION FACILITIES LOCATED AT ALAMEDA NAVAL AIR
STATION (ALAMEDA POINT) AND TO TAKE ALL OTHER NECESSARY
ACTIONS TO OBTAIN SAID REAL PROPERTY
WHEREAS, certain real property owned by the United States of
America, Department of Defense, located at Naval Air Station (NAS,
Alameda) has been declared to be surplus property by the Department
of Defense and may at the discretion of the General Services
Administration, be assigned to the Secretary of the Department of
the Interior for disposal for public park or recreation purposes,
pursuant to the provisions of section 203(K) (2) of the Federal
Property and Administrative Services Act of 1949 (63 Statutes 387),
as amended, and as implemented by 41 CFR Part 101-47; and
WHEREAS, surplus property may be transferred in fee to a
political subdivision of a State for public park or recreation
purposes through a public benefit conveyance, whereby the
Department of the Interior acts as the sponsoring agency for the
request of the local entity which desires to obtain said surplus
property from the Department of Defense; and
WHEREAS, surplus property may be obtained through a public
benefit conveyance upon such terms and conditions to be negotiated
with the Department of Defense and at a cost which can include a
discount of up to one hundred percent (100%) of fair market value;
and
WHEREAS, the Alameda Recreation and Park Department desires to
obtain certain recreational facilities at NAS through a public
benefit conveyance and seeks to submit an application for such a
conveyance to the Department of the Interior, the sponsoring
agency; and
WHEREAS, the application for surplus property at NAS, Alameda
is for a public benefit conveyance of 57 acres of real property,
which includes 8 acres of open space for recreational uses,
including a ball field, swimming pool, adjoining parking lot,
racquetball courts, and gymnasium; and
WHEREAS, the City is willing and able to use and maintain the
requested open space and public recreation facilities in
perpetuity, as required by 41 CFR Part 114-47.
NOW THEREFORE, BE IT RESOLVED that the City Manager is
authorized to prepare and submit an application for a public
benefit conveyance to the Secretary of the Department of the
Interior for 57 acres of open space and recreation facilities at
NAS, Alameda.
BE IT FURTHER RESOLVED that the City Manager is hereby
authorized to prepare and submit an application for a public
benefit conveyance to the Secretary of the Department of the
Interior for 57 acres of open space and recreation facilities at
NAS, Alameda.
BE IT FURTHER RESOLVED that the City Manager is authorized,
should said application be granted, to negotiate with the Secretary
of the Department of the Interior as to the terms and conditions of
conveyance of fee title to said 57 acres of real property at NAS,
Alameda at a 100% discount of fair market value.
BE IT FURTHER RESOLVED that the City Manager is directed to
obtain approval of the City Council of the purchase price, if any,
of the 57 acres of real property at NAS, Alameda and of any other
terms and conditions related to the conveyance which are not
required by statute or regulation.
BE IT FURTHER RESOLVED that the City Manager is further
authorized to take all necessary actions to obtain fee title to
said real property, including, but not limited to, preparing,
making and filing plans, applications, reports, and other
documents, executing, accepting, delivering and recording
agreements, deeds and other instruments pertaining to the transfer
of said real property, and the payment of all fees and charges
necessarily incurred in connection with the proposed transfer of
said real property for surveys, title searches, recordation of
instruments, or any other costs incurred with the public benefit
conveyance application, the negotiations for conveyance of the real
property and the proposed conveyance of the real property.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in regular meeting assembled on
the 16th day of November , 1999, by the following vote to wit:
AYES: Councilmembers Daysog, DeWitt, Johnson, Kerr and
Mayor Appezzato - 5.
NOES: None.

ABSTENTIONS: None.
