AUTHORIZING THE CITY MANAGER, THE EXECUTIVE DIRECTOR OF ALAMEDA
REUSE AND REDEVELOPMENT AUTHORITY, THE EXECUTIVE DIRECTOR OF THE
COMMUNITY IMPROVEMENT COMMISSION AND THE EXECUTIVE DIRECTOR OF
THE HOUSING AUTHORITY TO EXECUTE AN AGREEMENT TO SETTLE LITIGATION
INITIATED BY RENEWED HOPE HOUSING ADVOCATES AND ARC ECOLOGY
WHEREAS, Renewed Hope Housing Advocates and Arc Ecology filed a lawsuit
challenging the certification of the Environmental Impact Report for the Reuse Plan, the NAS /FISC
and the Alameda Point Improvement Plan; and
WHEREAS, the lawsuit also challenges, various actions undertaken by the City of Alameda
( "City "), the Alameda Community Improvement Commission ( "CIC ") and the Alameda Reuse and
Redevelopment Authority ( "ARRA ") including the approval of the LAMBRA designation, the
approval of the MOU with the U.S. Navy to receive the transfer of the FISC and Alameda NAS
property, and the approval of the LIFOC for Alameda Point; and
WHEREAS, the parties to the litigation ilave negotiated terms to settle the litigation; and
WHEREAS, the proposed terms of the settlement of litigation commit each of the City, the
CIC, the ARRA, and the Alameda Housing Authority ( "Housing Authority ") to various actions and
obligations; and
WHEREAS, the City, and the CIC, and the ARRA, and the Housing Authority all desire to
finally settle and resolve the pending litigation between the parties.
NOW, THEREFORE, BE IT JOINTLY RESOLVED by the Council of the City of
Alameda, the Alameda Community Improvement Commission, the Executive Board of the Alameda
Reuse and Redevelopment Authority, and the Housing Authority Board of Commissioners that the
City Manager, the Executive Director of ARRA, the Executive Director of the CIC, and the
Executive Director of the Housing Authority respectively are hereby authorized to execute the
Settlement Agreement on file in the office of the City Clerk and to bind the respective entities to the
teuus therein.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and
passed by the City Council, Community Improvement Commission, Alameda Reuse and Redevelopment
Authority and Housing Authority Board of Commissioners of the City of Alameda in a special joint
meeting assembled on the 20th day of March, 2001, by the following vote to wit:
