Resolution 13327CITY OF ALAMEDA RESOLUTION NO. 13327 APPROVING A NEGATIVE DECLARATION FOR THE AMENDMENT TO THE COMMUNITY IMPROVEMENT PLAN FOR THE BUSINESS AND WATERFRONT IMPROVEMENT PROJECT WHEREAS, the Community Improvement Commission of the City of Alameda (the "CIC ") has prepared an Amendment to the Community Improvement Plan (the "Amendment ") for the Business and Waterfront Improvement Project (the "BWIP "), which would change certain land use designations or descriptions of land use designations within the BWIP and make other textual changes in connection therewith; and WHEREAS, an initial study has been made to determine whether the proposed Amendment will have a significant effect on the environment; and WHEREAS, based on the results of the initial study, the CIC has prepared a Negative Declaration, which has been submitted to and has been considered by the City Council of the City of Alameda ( the " City Council ") in connection with the proposed adoption by the City Council of an ordinance adopting the Amendment; and WHEREAS, on April 3, 2001, the City Council and the CIC held a joint public hearing on the proposed Amendment and the Negative Declaration, and the City Council has considered all comments and testimony received pertaining thereto. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALAMEDA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council has reviewed and considered the information contained in the Negative Declaration prepared for the proposed Amendment and hereby approves the Negative Declaration. Section 2. Based upon the initial study, the Negative Declaration and comments and testimony received pertaining thereto, the City Council hereby finds and determines that the proposed Amendment will not have a significant effect on the environment based upon the following findings: The project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of fish or wildlife species, cause a fish or wildlife population to drop below sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of rare or endangered plants or animals or eliminate important examples of California history because the project would enhance the existing residential neighborhood environment and the urbanized site does not contain significant biological resources. The site contains a residence of potential historical importance which would be retained and preserved under the proposed General Plan designation and zoning. The project does not involve impacts which are individually limited but "cumulatively considerable" (e.g. that the incremental effects of the project are considerable when viewed in connection with the effects of past projects), the effects of other current projects and the effects of probable future projects, because the project would not involve environmental impacts which could compound with effects of past, current or probable future projects. The project does not have any environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly because the project would be consistent with, and compatible with, the surrounding land uses. The project does not have the potential to achieve short-term, to the disadvantage of long -term, environmental goals, because the project involves redevelopment of a commercial site with residential use, under a Planned Development and General Plan and Zoning amendments necessary for the project which would be consistent with long- teiiii environmental and land use goals. Section 3. The City Clerk of the City of Alameda is authorized to file a Notice of Determination with the County Clerk of the County of Alameda and the Office of Planning and Research, if applicable, following the adoption by the City Council of an ordinance adopting the Amendment. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a Special Joint City Council and Community Improvement Commission meeting assembled on the 3rd day of April, 2001, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, and Mayor Appezzato 4.
