Resolution 13328CITY OF ALAMEDA RESOLUTION NO. 13328 APPROVING GENERAL PLAN AMENDMENT, GPA- 00 -03, TO REDESIGNATE 616 TO 626 BUENA VISTA AVENUE FROM COMMUNITY COMMERCIAL TO MEDIUM DENSITY RESIDENTIAL ON THE GENERAL PLAN DIAGRAM WHEREAS, an application was made on September 14, 2000 by Alameda Development Corporation requesting a General Plan Amendment, GPA- 00 -03, to redesignate approximately 26,000 square feet of area in three properties at 616, 620 and 626 Buena Vista Avenue from Community Commercial to Medium Density Residential on the General Plan Diagram; and WHEREAS, the proposal for a General Plan Amendment is part of a application which also includes a Rezoning, R- 00 -03; and WHEREAS, the subject property includes Assessor Parcel Numbers 074- 0431 -024, 074- 0431 -025 and 074 - 0431 -026; and WHEREAS, the project is located within the boundaries of the Business and Waterfront \-1, M Improvement Project, in which an amendment from Commercial to Commercial /Residential has been proposed in connection with the General Plan Amendment; and WHEREAS, the Planning Board held a public hearing on this application on February 13, 2001, and examined pertinent maps, drawings, and documents, and recommended to the City Council approval of the General Plan Amendment; and WHEREAS, an Initial Study has been prepared pursuant to the California Environmental Quality Act and has been found to be complete and correct, and a Negative Declaration has been adopted; and WHEREAS, the City Council held a public hearing on April 3, 2001 and examined pertinent maps, drawings and documents; and WHEREAS, the City Council has made the following findings: 1. The proposed General Plan Amendment is consistent with General Plan Policy, 2.5.g which states that the City should: "Encourage retention and addition of housing in the Park Street, Webster Street and Neighborhood Business Districts." The site is on the border of the Webster Street Business District and would provide for transition from commercial to residential uses in the neighborhood. 2. The subject site is partially residentially developed, is adjacent to a residential use on the west, north and south, is located on an intersecting street rather than on the Webster Street business corridor, and is too small to support a viable commercial use with required off - street parking. NOW, THEREFORE, BE IT RESOLVED that the City Council approve General Plan Amendment, GPA -00 -03, to redesignate 616 to 626 Buena Vista Avenue from Community Commercial to Medium Density Residential on the General Plan Diagram. NOTICE. No judicial proceedings subject to review pursuant to California Code of Civil procedures Section 1085 may be prosecuted more than ninety (90) days following the date of a decision by the City Council, or any final action on any appeal, plus extensions authorized by California Code of Civil Procedure Section 1085. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a Special Joint City Council and Community Improvement Commission meeting assembled on the 3rd day of April, 2001, by the following vote to wit: AYES: Councilmembers Daysog, DeWitt, Johnson, and Mayor Appezzato - 4.
