Resolution 13585CITY OF ALAMEDA RESOLUTION NO. 13585 WANING PARCEL MAP REQUIREMENT FOR ALAMEDA POINT COLLABORATIVE LEASEHOLD INTERESTS WHEREAS, the Alameda Reuse and Redevelopment Authority ( "ARRA ") leases the foinier Alameda Naval Air Station ( "Alameda Point ") property from the United States Government, Department of the Navy, pursuant to a "Lease in Furtherance of Conveyance; and WHEREAS, pursuant to the Base Closure Community Redevelopment and Homeless Assistance Act of 1994, the Alameda Point Collaborative and/or its various providers sublease from the ARRA certain improved property located in the West Housing area of Alameda Point as described in Attachment 1, for the purpose of providing transitional and permanent housing and related activities and services for the formerly homeless; and WHEREAS, the Alameda Point Collaborative has created legal descriptions of their leasehold interests in the form of "leasehold area maps," which also depict the reservation of rights in the ARRA for access to existing public utilities and potential future utilities, sidewalks, landscaping and other public benefit improvements and which will be attached to the long term lease ( "Legally Binding Agreement "); and WHEREAS, the Alameda Point Collaborative, on behalf of its member providers as well as on its own behalf, has requested that the City of Alameda waive the parcel map requirements of the Subdivision Map Act, which would otherwise apply to the creation of leasehold interests over a portion of the Alameda Point property; and WHEREAS, a conveyance of property interests (including a leasehold interest) to or from a governmental agency is exempt from the requirements of the Subdivision Map Act; and WHEREAS, under Alameda Municipal Code Section 30- 78.6(b), the City Council of the City of Alameda may waive the requirement for a parcel map, if it makes certain findings; and WHEREAS, subleased properties in question are currently occupied by tenants of existing residential and commercial or warehouse structures, which are currently serviced by functioning sanitary facilities, water supply and other necessary utilities, and that sufficient ingress and egress to the residential and other buildings exists to permit their occupancy and continued use; and WHEREAS, a waiver of the parcel map requirement is necessary and appropriate to enable the Alameda Point Collaborative to record its Legally Binding Agreement(s), without formally subdividing the Alameda Point property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that said Council hereby finds that the properties located in West Housing as described in Attachment 1 and more particularly described by the "leasehold area maps" attached hereto as Exhibits A, B, C and D have existing improvements (including residential, commercial and warehouse structures), are currently occupied by tenants who receive sanitary facilities and water supply to the property, and have sufficient ingress and egress to occupy and continue to use the property for the purposes identified in the long term lease or Legally Binding Agreement; and BE IT FURTHER RESOLVED: L that the City Council of the City of Alameda finds that a waiver of the City's parcel map requirement is appropriate and necessary to implement the conveyance of the leasehold interests to the Alameda Point Collaborative and its member providers by facilitating the lessee's ability to record its leasehold interests, which will help implement the purposes of the Federal Base Closure Community Redevelopment and Homeless Assistance Act of 1994, and therefore, the request for waiver of parcel map requirements is GRANTED for the areas shown on Exhibit A; 2. that the City Council of the City of Alameda finds that a waiver of the City's parcel map requirement is appropriate and necessary to implement the conveyance of the leasehold interests to the Alameda Point Collaborative and its member providers by facilitating the lessee's ability to record its leasehold interests, which will help implement the purposes of the Federal Base Closure Community Redevelopment and Homeless Assistance Act of 1994, and therefore, the request for waiver of parcel map requirements is GRANTED for the areas shown on Exhibit B; 3. that the City Council of the City of Alameda finds that a waiver of the City's parcel map requirement is appropriate and necessary to implement the conveyance of the leasehold interests to the Alameda Point Collaborative and its member providers by facilitating the lessee's ability to record its leasehold interests, which will help implement the purposes of the Federal Base Closure Community Redevelopment and Homeless Assistance Act of 1994, and therefore, the request for waiver of parcel map requirements is GRANTED for the areas shown on Exhibit C; and 4. that the City Council of the City of Alameda finds that a waiver of the City's parcel map requirement is appropriate and necessary to implement the conveyance of the leasehold interests to the Alameda Point Collaborative and its member providers by facilitating the lessee's ability to record its leasehold interests, which will help implement the purposes of the Federal Base Closure Community Redevelopment and Homeless Assistance Act of 1994, and therefore, the request for waiver of parcel map requirements_ is GRANTED for the areas shown on Exhibit D.
