AMENDING THE MASTER FEE RESOLUTION TO ESTABLISH AN APPLICATION FEE
FOR A DETERMINATION WITH RESPECT TO THE STORM WATER UTILITY FEE
WHEREAS, by its Resolution No. 12243 (as amended), the City Council has established
a fee to regulate the increased discharge of untreated storm water into the City's storm sewer
system that occurs when an owner, occupant, or other user of property located in the City installs
or maintains impervious surfaces on such property, but fails to mitigate such discharge or the
pollution likely to enter the City's storm sewer system as a result of such discharge before it is
discharged into the City's storm sewer system; and
WHEREAS, Resolution No. 13 6 3 5 provides that a person subject to the fee may
request that the Public Works Director make certain determinations with respect to (i) the
quantity of impervious surface installed or maintained by that person and/or (ii) measures taken
to mitigate polluted discharges that result from the installation or maintenance of impervious
surfaces by that person;
WHEREAS, making such a determination will require, on average, at least two hours of
engineering services provided by the City's Public Works staff or consultants; and
WHEREAS, the City's current cost per hour for such engineering services is $52.00, so
the cost of two hours of such services is $104.00; and
WHEREAS, Resolution No. 13 6 3 5 requires that a request for a determination be
accompanied by payment of an application fee in an amount established by resolution of the City
Council; and
WHEREAS, the City Council desires to establish such application fee.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda
that the Master Fee Resolution for the City of Alameda be amended to establish an "Application
Fee for a Determination of the Public Works Director Pursuant to Resolution No. 13635
(the "Fee ").

BE IT FURTHER RESOLVED that the amount of the Fee shall be $100.00 per
