AUTHORIZING THE APPLICATION OF FUNDS TO CONSTRUCT A BAY TRAIL
SEGMENT AROUND SEGMENTS OF PADEN SCHOOL BY PADEN PTA; AND
AGREEING TO ENTER INTO A JOINT-USE AGREEMENT WITH THE ALAMEDA
RECREATION AND PARK DEPARTMENT FOR USE AND MAINTENANCE OF THE
BAY TRAIL FACILITY
WHEREAS, Section 10900-10916, inclusive, of the Education Code of the State
of California, authorize cities, counties and public school districts to organize, promote
and conduct such programs of community recreation as will contribute to the attainment
of general educational and recreational objectives for the children and adults of the
State; and
WHEREAS, the City and the Alameda Unified School District recognize the
public need for open space and access to natural resources for public enjoyment and
recreation and desire to cooperate in the use of an outdoor facility to be constructed at
the William G. Paden School, on Central Avenue, in Alameda (hereinafter referred to as
"Bay Trail Facility"); and
WHEREAS, it is the mutual desire of the City and the Alameda Unified School
District to promote a program of community recreation in connection with the use of the
Bay Trail Facility; and
WHEREAS, the project is consistent with the Alameda Recreation and Park
Department goals and the City of Alameda General Plan to expand Alameda's park
system; maximize visual and physical access to the shoreline; coordinate with the
Alameda Unified School District to obtain shoreline access at Paden; and to seek grants
for implementation of the Bay Trail project; and
WHEREAS, the Alameda Recreation Commission has expressed its support for
the Paden School Bay Trail planning and feasibility study; and
WHEREAS, the governing bodies of City and the School District may cooperate
with each other to carry out the purposes of community recreation, and to that end may
enter into an agreement with each other and may do any and all things necessary to aid
and cooperate in carrying out the purposes of community recreation; and
WHEREAS, Section 6502 of the Government Code of the State of California
authorize public agencies through their governing bodies to jointly exercise any power
common to the contracting agencies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda that:
1. The City Council hereby supports the filing of grant applications for
construction plans and construction costs for a Bay Trail Facility as
described in the Paden Bay Trail Study; by the Paden PTA, or the Paden
PTA in partnership with another non- profit or government entity; and
2. The City Council authorizes the City Manager to develop and approve a
Joint Use Agreement with the Alameda Unified School District for the
Paden School Bay Trails.
