AUTHORIZING OPEN MARKET PURCHASE
PURSUANT TO SECTION 3-15 OF THE ALAMEDA CITY CHARTER
FOR REPAIR OF THE
BAY FARM ISLAND SEAWALL DIKE, ALONG SHORELINE PARK
AND AUTHORIZING CITY MANAGER TO ENTER INTO SUCH AN
AGREEMENT
(REQUIRES FOUR AFFIRMATIVE VOTES)
WHEREAS, the storm on December 30, 2005 washed out sections of the
rock fill protection along the dike resulting in erosion of the bank and jogging path
at the Bay Farm Island Seawall Dike, along Shoreline Park; and
WHEREAS, to protect the infrastructure facilities and reopen the jogging
paths, the armor protection along the dike must be restored; and
WHEREAS, the undermined section of the promenade must be
underpinned to prevent collapse of the undermined section of the concrete
promenade damage to the underlying storm drain line; and
WHEREAS, immediate action is required to prevent further damage to the
dike and promenade; and
WHEREAS, Section 3-15 of the City Charter provides that the City
Council, by four affirmative votes, can authorize an open market purchase if it
determines that great necessity or emergency requires immediate action; and
WHEREAS, the City Council finds that great necessity requires that
immediate action be taken to repair the damage, without delays occasioned by
the formal bidding process.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda, pursuant to Section 3-15 of the City Charter, and by four affirmative
votes, the City Manager, in cooperation of the Public Works Department, is
hereby authorized to enter in an agreement, without bid, for the repair of the Bay
Farm Island Seawall Dike along Shoreline Park.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in the regular meeting of the City
Council on the 17th day of January, 2006, by the following vote to wit:
AYES: Councilmembers Daysog, deHaan, Gilmore, Matarrese
and Mayor Johnson — 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
