ORDERING VACATION OF A PORTION OF A 25-FOOT WIDE PUBLIC
UTILITY EASEMENT WITHIN TRACT 1866, FILED MAP BOOK 38, AT
PAGE 50 TO 54, ALAMEDA COUNTY OFFICIAL RECORDS;
VACATION OF TWO 10-FOOT POWER EASEMENTS, FILED RE:191,
IMAGE 407 AND #79-196972 O.R., ALAMEDA COUNTY OFFICIAL
RECORDS AND ACCEPTANCE OF NEW 25-FOOT WIDE PUBLIC
UTILITY EASEMENT
WHERAS, on October 30, 1957 a 25-Foot Wide Public Utility
Easement within Tract 1866 was granted to the City of Alameda by South
Shore Center and was filed in the Office of the County of Alameda Recorder in
Book 38, at Pages 50 to 54; and
WHEREAS, on October 21, 1960 a 10-Foot Power Easement,
described as a portion of Parcel No. 1 of that certain Grant of Easement made
to the City of Alameda and was filed in the Office of the County of Alameda
Recorder in Reel 191, Image 407; and
WHEREAS, on October
described as Parcel D of that certain
Alameda and was filed in the Office
Instrument No. 79-196972; and
2,1979 a 10-Foot Power Easement,
Grant of Easement made to the City of
of the County of Alameda Recorder as
WHEREAS, a portion of the existing 25-Foot Public Utility
Easement and 10-Foot Power Easements are no longer necessary for
infrastructure or access purposes and can be vacated.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Alameda that the public utility and power easements be vacated
pursuant to the provisions of Division 9, Part 3, Chapter 4, Article 8333 (c) of
the Streets and Highways Code. Legal descriptions and plats of the subject
easements are hereby accepted.
BE IT FURTHER RESOLVED that the City Clerk shall cause
certified copies of this resolution, attested under seal, to be recorded in the
County Recorder's Office and from and after the date of this resolution is
recorded, said easements as recorded on October 30, 1957; October 21, 1960
and September 17, 1979 no longer shall constitute a public service easement.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in the regular meeting of the City
Council on the '7th day of March, 2006, by the following vote to wit:
AYES: Councilmembers Daysog, deHaan, Gilmore, Matarrese
and Mayor Johnson - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
