ESTABLISHING A LONG -TERM PARK USE POLICY
WHEREAS, the City of Alameda receives requests for the long term use
of city parks and recreation facilities; and
WHEREAS, the intent of the policy is to protect and preserve Alameda's
Z parks and recreation facilities, to maintain their public character and to ensure
® their availability for public use and enjoyment.
1. NOW THEREFORE, the City Council of the City of Alameda resolves
that the Long -Term Park Use Policy shall be adopted as follows:
2. LONG -TERM USE SHALL BE DEFINED AS - requests for designated
use of 72 hours or more.
3. NON - PROFIT ORGANIZATION SHALL BE DEFINED AS —
Organizations must be non - profit, tax - exempt, non - restrictive in
membership, meet regularly, have a definite organizational structure, and
established bylaws.
4. LIMITATIONS ON LONG -TERM PARK USE;
a. Individuals or organizations offering non -City sponsored programs
or activities that compete, conflict and /or are comparable to those
provided or sponsored by ARPD will not be granted long -term use
of park land or recreation facility space.
b. Alameda Recreation and Park Department programs and
activities will not be displaced or restricted in any way to
accommodate long -term use by a requesting entity.
c. Long -term use of park land or recreation facilities by non -City
sponsored entities for profit making enterprises will not be
entertained.
d. Uses by non -City sponsored, non - profit organizations may occupy
a maximum of 15% of the total acreage available in the affected
park.
e. Uses requiring changes to the existing conditions of park land or
recreation facilities (e.g., construction of additional facilities,
installation of barriers to open space, or the placement of tents or
shelter structures larger than 8 feet by 8 feet, and or those
requiring significant anchoring or footings) must comply with
established Planning and Building policies and procedures of the
City of Alameda and are subject to approval by the City Council.
5. REVIEW PROCESS - The Recreation and Park Commission will have
the authority to approve or deny applications for long -term use of park
land or recreation facilities. Appeals for decisions of the Recreation
and Park Commission regarding applications for long -term park use
shall be made to the City Council.
a. Entities requesting long term use of park land or recreation
faculties extending over a period of 72 hours or greater shall file
an application with the Director of the Alameda Recreation and
Park Department or his /her designee.
b. The applicant should then Schedule an informational meeting with
the Recreation and Park Director to review the process and
estimated time line. The application will then be scheduled for
review by the Recreation and Park Commission. Prior to review
by the Recreation and Park Commission the applicant will be
required to:
1. Conduct a community meeting with the neighborhood
currently served by the area requested.
2. Give written notification to local residents, both property
owners and renters, within 300 feet of the facility by
placement of a public notice once in a newspaper of
general circulation with the City at least 10 days prior to the
date of review
3. Address issues such as potential traffic problems, litter,
parking, and noise during the informational meeting.
4. Provide detailed drawings illustrating any structural or
aesthetic, addition or deletions.
5. Comply with the established policies and procedures of the
City of Alameda Planning Department regarding the
placement of structures and hours of operation.
6. Demonstrate the ability to construct, design, and maintain
the facilities requested as determined by the Recreation
and Park Commission, Planning Board and City Council.
7. Attend a hearing before the Recreation and Park
Commission for action on the application. Unless the
matter is appealed to the. City Council within 10 calendar
days the decision of the Recreation and Park Commission
is final.
8. Return the park land or recreation facility to its
preconstruction condition upon termination of the use.
9. Accommodate participation by the general public and not
be limited by membership association.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of
Alameda does hereby establish the Long -Term Park Use Policy
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Council of the City of Alameda in the regular meeting of the City
Council on the 7th day of March, 2006, by the following vote to wit:
AYES: Councilmembers Daysog, deHaan, Gilmore, Matarrese
and Mayor Johnson - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
