ORDERING THE VACATION OF A PORTION CF MARKET STREET,
IN THE CITY. OF ALAMEDA.

WHEREAS, the Council of the City of Alameda did, on the Sth day cf December,
1055, pass its Tiesolution of intention 'Pc. 5191, declaring it3 intention to order the
vacation, closing and abandonment of that certain portion of Market Street, in the
Cityo f Alameda, County of Alameda, State of California, more particularly described
in said Resolution of Intention es follows:
(a) Market Street from the southerly line of San J093 Avenue
to the northerly line of Adams Street;
(s) Market Street from the southerly line of Ademo Street
to the northerly line of Washington Street;
(c) Market Street from the southerly line of Washinnton Street
to the northerly line of Fillmore Street.
and
WHEREAS, by said Resolution of intention said Council declared and deter-
mined that public convenience and necessity require the reservation to the City of
Alameda of permanent easements and rights-ef-way over ant-lacnoon certain parcels of
land situate in those portions of Market Street proposed to be vacated, for the pur-
pose of constructing, operating, maintaining, replacing, renewing and repairing
thereon storm and sanitary sewers, or either of them, and did by said Resolution of
Intention reserve to the City of Alameda, for the aforesaid purposes, perrmnent ease
ments and rights-of-way over and across those certain parcels of land hereinafter
described; and
WHEREAS, the portions of said street to be vacated and abandoned and the
details of said vacation are more particularly shown upon that certain map known as
Drawing 4330, Case 51, bearing the legend: "Abandonment of Market St., Fillmore St.
to San Jose Aye.", wnich map was by said Resolution af Intention approved. for the
purpose of this proceeding and was ordered filbd in the office of the City Clerk of
the City of Alameda and marked 'Filed Dec. 6, 105,5", and which map was in said reso-
lution referred to for further particulars as to the proposed vacation; and
WHEREAS, the City Clerk of the City of Alameda caused said Resolution of
intention to be published in the manner prescribed be law for the publishing of
ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper cf
general circulation published. and circulated in said city- and the official news-
paper thereof; and
WHEREAS, proof of said publication is evidenced by an affieNnyit of pub-
lication. now on file in the offic of the City. Clerk of said city; and
WHEREAS, proof of said posting of such notices is evidenced by the affi-
davit of the person posting said notices, which affidavit sets forth the facts regard-
inn such posting and in now on. file in the office of the 'City Clerk said City; and
17E1E1S the matter of said proposed. vacation came on regularly for hearing
before the Council of the Gityof Alameda at this, its 18 121< meeting, OD the 3d. day.
of January, 1956, and at the time and place fixed in said Resolution of intention,
and at such hearing the said Council heard the evidence offered. by all persons
internsted in said street vacation, and a full hearing thereon having been had and
the matter submitted for determination;
NOW THEREFORE, BE IT RESOLVED NY THE COUNCIL OF' THE CITY OF AIAIYEDA that
said Council hereby finds and determines, from all the evidence submitted, that the
street and parts thereof in said Resolution of Intention and hereinbefore more parti-
cularly described are unnecessary for present and prospective public street purposes
and that public interest requires the vocation. of said portions of said street.
BE IT FURTHER RESOLVED that the portions of said Mnrket Street in said
Resolution of intentibn. and hereinbefore more particularly described be, and the same
are hereby vacated and obandbned,
