CALIFORNIA, '0 RE A PUB TIC NUISANCE (ARK NO. 12
WHEREAS, the Building Inspector of the City of Alameda has given notice
in the manner provided by Section 10-527 of the Alameda Municipal Code, dlrecting
the owner or owners of that certain dwelling herein described to appear before
the Council of the City of Alameda on Thursday, February 23, 1955, at the hour of
7:30 P. M., and show cause why said building should not be condemned as a public
nuisance and removed or razed as provided in the Alameda Municipal Code; and
WHEREAS, it appears that said notice was duly and regularly given in the
form and manner provided by said Code, and the matter coming on regularly for
hearing before this Council. at this time, and witnesses being sworn and testimony
being given by Inc Building Inspector, the Health inspector, and other competent
pr's, respecting the condition of said dwelling, and the owner of said building
being afforded an opportunity to be heard, and said owner being present in person,
the Council proceeded to a consideration of said matter, and after due ccnsider-
ation of the testimony of all witnesses and other evidence presented in said
matter,
IT IS HEREBY RESOLVED, DETEAvii= AND DECLARED, and the Council of the
City of Alameda finds that the dwelling herein described in the it of Alameda
is in violation of Section 10-126 of the Alameda Municipal Code and is hereby
declared to be a public nuisance; and
RE IT FURTHER RESOLVED, that the herein described dwelling be, and the
same is hereby condemned as a public nuisance and the owner or owners thereof are
hereby prohibited from its further use or occupation for the purpose of a dwelling,
said order to become effective thirty (30) days from the date hereof.
BE IT FURTHER RESOLVED, that the Building Inspector is hereby authorized
and directed to post in a conspicuous place on said dwelling structure a notice
in the form and in the manner required by Section 10-529 of the Alameda Municipal
Code.
HE IT FURTHER RESOLVED, that if said nuisance be net so abated as
required by the Alameda Municipal Code thirty (30) days after the passage of this
resolution, the City Manager is hereby authorized and directed to seize and/or
raze said structure in the manner provided by Sections 10-5210 and 10-5211 of the
Alameda Municipal Code.
