Resolution 05679L I 1 RESOLUTION NO. 5679 RESOLUTION OF THE CITY OF ALAMEDA DECLARING PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STORM WATER DRAINAGE PURPOSES, AUTHORIZING COMMENCEMENT OF CONDEMNATION PROCEEDINGS AND EMPLOYMENT OF SPECIAL LEGAL COUNSEL THEREFOR. RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA, and said Council hereby finds and determines, that public interest and necessity require the acquisition, construction or completion of storm water drainage facilities over each of the par- cels of real property described in Exhibit "A ", attached hereto and incorporated herein by reference as if fully set out herein; and that each of the rights -of -way and easements hereinafter described is necessary therefor; that the interest sought to be condemned for such storm water drainage purposes is a perpetual right -of -way and easement over each of the parcels of real property set out in Exhibit "A" per- mitting water to flow and drain over said property without obstruction of any nature whatsoever; said right -of -way and easement over each such parcel shall be for the purpose of operating and maintaining such parcel for storm water drainage purposes, giving to the City of Alameda all rights to go in and upon said parcel in furtherance of said purposes, with the right and power to remove or deposit silt, dirt, sand and other material from and to said parcel to accomplish said purposes; provided, however, that such right -of -way and easement shall not be construed or deemed to deny to the owner or owners of said parcel the right to utilize the same and the water thereon for boating, swimming and other recreational purposes not inconsistent with such right -of -way and easement; provided, further, that such right -of -way and easement shall not be construed or deemed to give to the City of Alameda the right to install, maintain or operate on said parcel, for any purpose, any structure, fill or works which would prevent or impede the free flow of storm drainage water over such parcel. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, directed to commence condemnation proceedings in eminent domain for the acquisition of said real property, and that the Mayor be, and he is hereby, instructed, author- ized and directed, for and on behalf of said City and its City Council, to subscribe to a complaint in the Superior Court of said Alameda County for the condemnation of said real property for storm water drainage purposes. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, author- ized to employ special legal counsel for and on behalf of the City of Alameda in the furtherance and prosecution of said condemnation proceedings. BE IT FURTHER RESOLVED that the real property sought to be condemned herein is situated within the City of Alameda, County of Alameda, State of California, and is more particularly described in Exhibit "A "; which is attached hereto and incorpor- ated herein by reference as if fully set out herein.
