RESOLUTION OF THE (3 13 OF THE CITY OF ALAMEDA
APPROPRIATING AND AUTHORIZING PAYMENT CP MONEY FOR
SATISFACTION OF ,TUDGMENT, AND OTHER INCIDENTAL
EXPENSES IN CONDEMNATIONS PROCEEDING ASAIrkET
CERTAIN REAL PROPERTY' FOR PUBLIC PARK PURPOSES
(LANE - GODFREY ARK).
WHEREAS, by previous Resolution No. 5570, tho City Attorney was instructed
to proceed with condemnation proceed:Inge against certaln real property owned by
R— Beatrice Lane for the purpose of acquiring said. property for public park pur-
poses; and
WHEREAS, the Superior Court of the State of California, in. and for the
County of 3) 1133» by stipulation, will render a judgment condemning said real pro-
perty.. in the case of City of Alameda, a municipal corporation, Plaintiff, vs. R.
Beatrice Lane, at al., Defendants No. 28E290, to the use and benefit of the City
of Alameda. anon condition the City of Alameda. pay unto the defendants therein the
sum of $11,500.; and.
NOW ERE:7E7010 , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA:
That there is hereby appropriated from the Capital Outlays Fund the
amount of $11,625. to satisfy the said judgment regardtmg acquisition of thp said
real property, cost of title insurance, and other incidental expenses.
That good and merchantable title in fee simple in said real property be
vested in the City of Alameda by operation of said judgment, free and clear of all
objections, liens and encumbrances; excepting, however, assessment No. 111 for
Sewering of Bay Farm Island, which became a lien on October
Lhat title of said. real property be evidenced by a policy of title
insurance issued by the Oakland. Title Insurance Company, a corporation, insuring
title En the City, as provided in the preceding paragraph, said title insurance to
be at the expense of thp City 13'' Aaameda.
That upon execution and filing of a satisfaction of jutigment by the
defendants in that certain case entitled City of Alameda, a municipal corporation,
Plaintiff, vs. R. Beatripe Lane, et al., Defendants, No. 284290, and conditioned
upon the issuance of a title insurance policy, as aforesaid, to be approved by the
City Attorney, a Warrant of the City be drawn for $11,625., payable to the order
of and delivered to said Oakland Title insurance Company, a corporation, as escrow
holder, for the purpose of effecting the '-02130111380 08 of said purchase.

and regularly introduced amid adopted by the Council of the City of Alameda in. regu-
lar meeting assembipd on thp 3rd clay of September, 1557, by the felloping vote,
