Resolution 14808CITY OF ALAMEDA RESOLUTION NO. 14808 APPROVE THE JOINT EXERCISE OF POWERS AGREEMENT CREATING THE ENERGY COUNCIL AND AGREEING TO BECOME A MEMBER OF THE ENERGY COUNCIL WHEREAS, the Alameda County Waste Management Authority (herein referred to as StopWaste.Org) is asking its fifteen member agencies to approve a Joint Exercise of Powers Agreement (JPA) creating an Energy Council and to become members of the Energy Council; and WHEREAS, there is an opportunity to continue and expand energy- efficiency programs through funding from multiple sources, including regional, state, and federal agencies, investor-owned utilities and private foundations; and WHEREAS, based on input from potential funders, a Joint Exercise of Powers agency that is expressly authorized to seek and expend energy-related funds, separate from Stopwaste.Org, would provide a clear signal that our region prioritizes energy management and has established a dedicated governance structure for this purpose; and WHEREAS, the attached JPA would create an independent Energy Council to seek funding; develop and implement sustainable energy initiatives that reduce energy demand and increase energy efficiency; and advance the use of clean, efficient, and renewable resources available in the region for the benefit of the member agencies and their constituents; and WHEREAS, no debt, liability, or obligation or obligation of the Energy Council shall constitute a debt, liability or obligation of City of Alameda pursuant to Government Code Section 6508.1 and the terms of the agreement; NOW, THEREFORE BE IT RESOLVED that the City of Alameda approves the attached JPA for the Energy Council, and authorizes and directs the City Manager to execute the agreement and agrees to become a member of the Energy Council. * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 21st day of May, 2013, by the following vote to wit: AYES: Councilmembers Chen, Daysog, Ezzy Ashcraft, Tam and Mayor Gilmore – 5.
