AMENDING MASTER FEE RESOLUTION NO. 12191 TO REVISE THE CIVIL
PENALTIES FOR PARKING VIOLATIONS OF THE MUNICIPAL CODE AND
THE CALIFORNIA VEHICLE CODE
WHEREAS, the California Vehicle Code Section 40203.5(a) provides the
governing body of the jurisdiction where the notice of violation is issued m ay establish a
schedule of parking penalties for parking violations; and
WHEREAS, Vehicle Code Section 40200.4(f) defines the term “parking penalty”
to include, among other things, any late payment penalty and costs of collection; and
WHEREAS, Vehicle Code Section 40203.5(a) further provides that “[t]o the
extent possible, issuing agencies within the same county shall standardize parking
penalties”; and
WHEREAS, Vehicle Code Section 40203.5(b) requires that parking penalties
shall be collected as civil penalties”; and
WHEREAS, the City Council at the August 27, 1991 Special City Council meeting
directed City staff to amend the Alameda Municipal Code to reflect that City fees shall
be set by City Council resolution; and
WHEREAS, Resolution No. 12191 (Master Fee Resolution), as amended codifies
existing fees for various City services and permits.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda that civil penalties for parking violations are established and revised as set
forth in Exhibit 1, to City of Alameda Resolution, attached hereto and incorporated
herein by this reference, to become effective July 1, 2013.
BE IT FURTHER RESOLVED that all fees and/or penalties established by
Master Fee Resolution 12191 which are inconsistent with the fees and/or penalties
established by this Resolution are hereby repealed.
