CITYOFALAMEDARESOLUTIONNO.14880 OFFORMATIONOFTHECITYOFALAMEDACOMMUNITYFACILITIES DISTRICTNO.13-1(ALAMEDALANDINGPUBLICIMPROVEMENTS), AUTHORIZINGTHELEVYOFASPECIALTAXWITHINTHEDISTRICT, PRELIMINARILYESTABLISHINGANAPPROPRIATIONSLIMITFORTHE DISTRICT,ANDSUBMITTINGLEVYOFTHESPECIALTAXANDTHE ESTABLISHMENTOFTHEAPPROPRIATIONSLIMITTOTHEQUALIFIED ELECTORSOFTHEDISTRICT ""'-'",",WHEREAS,onDecember3,2013,thisCityCounciladoptedaresolutio" "DeclaringIntentiontoEstablishaCommunityFacilitiesDistrictandtoAuthorizetheLevy 0 SpecialTaxesTherein-AlamedaLandingPublicImprovements"(the"Resolution Intention")statingitsintentiontoformtheCityofAlamedaCommunityFacilitiesDistrictNo. 13-1(AlamedaLandingPublicImprovements)(the"District")pursuanttotheCity AlamedaSpecialTaxFinancingImprovementCode,AlamedaMunicipalCode3-70.1etseq.(the"Law");and WHEREAS,theResolutionofintention,incorporatingbyreferenceamapof theproposedboundariesoftheDistrictanddescribingthepublicimprovements(the "Facilities")eligibletobefinancedbytheDistrict,thecostoffinancingtheFacilitiesandthe rateandmethodofapportionmentofthespecialtaxtobeleviedwithintheDistricttopay costsoftheFacilitiesandtheprincipalandinterestonbondsproposedtobeissuedforthe DistricttofinancecostsoftheFacilities,isonfilewiththeCityClerkandtheprovisions thereofareincorporatedhereinbythisreferenceasiffullysetforthherein;and WHEREAS,theResolutionofIntentioncalledforapublichearingonthe DistricttobeheldonJanuary7,2014,andnoticeofthepublichearingwaspublishedasrequiredbytheLaw;and WHEREAS,onthisdatethisCityCouncilheldthepublichearingasrequired bytheLawandtheResolutionofIntentionrelativetotheproposedformationoftheDistrict;and WHEREAS,atthehearingallinterestedpersonsdesiringtobeheardonall matterspertainingtotheformationoftheDistrict,theFacilitieseligibletobefundedbythe DistrictandthelevyofthespecialtaxintheDistrictwereheardandafullandfairhearingwasheld;and WHEREAS,atthehearingevidencewaspresentedtothisCityCouncilonthe mattersbeforeit,includingareportbytheDirectorofPublicWorksoftheCity(the"Report") astotheFacilitieseligibletobefundedbytheDistrictandthecoststhereof,acopyofwhich isonfilewiththeCityClerk,andthisCityCouncilattheconclusionofthehearingwasfullyadvisedregardingtheDistrict;and WHEREAS,writtenprotestswithrespecttotheformationoftheDistrict and/orthefurnishingofspecifiedtypesofFacilitiesbytheDistrictasdescribedintheReport havenotbeenfiledwiththeCityClerkbyfiftypercent(50%)ormoreoftheregistered votersresidingwithintheterritoryoftheDistrictorpropertyownersofone-half(1/2)ormore oftheareaoflandwithintheDistrictandnotexemptfromthespecialtax;and WHEREAS,thespecialtaxproposedtobeleviedintheDistricttopayfor costsoftheFacilitiesassetforthinExhibitBtotheResolutionofIntentionhasnotbeen eliminatedbyprotestbyfiftypercent(50%)ormoreoftheregisteredvotersresidingwithin theterritoryoftheDistrictortheownersofone-half(1/2)ormoreoftheareaoflandwithin theDistrictandnotexemptfromthespecialtax. NOW,THEREFORE,BEITRESOLVEDbytheCityCounciloftheCityof Alamedathat: 1.Theforegoingrecitalsaretrueandcorrect. 2.TheproposedspecialtaxtobeleviedwithintheDistricthasnotbeen precludedbymajorityprotestpursuanttoSection3-70.30oftheLaw. 3.AllpriorproceedingstakenbythisCityCouncilinconnectionwiththe establishmentoftheDistrictandthelevyofthespecialtaxintheDistricthavebeenduly consideredandareherebyfoundanddeterminedtobevalidandinsubstantialconformity withtheLaw. 4.Thecommunityfacilitiesdistrictdesignated"CityofAlamedaCommunity FacilitiesDistrictNo.13-1(AlamedaLandingPublicImprovements)"isherebyestablished pursuanttotheLaw. 5.TheboundariesoftheDistrict,asdescribedintheResolutionofIntention andsetforthintheboundarymapoftheDistrictrecordedonDecember12,2013inthe AlamedaCountyRecorder'sOfficeinBook18ofMapsofAssessmentandCommunity FacilitiesDistrictsatPage45(instrumentno.2013382195),areherebyapproved,are incorporatedhereinbythisreferenceandshallbetheboundariesoftheDistrict. 6.ThetypesoffacilitieseligibletobefundedbytheDistrictpursuanttothe LawareasdescribedinExhibitAtotheResolutionofIntentionwhichExhibitisbythis referenceincorporatedherein. 7.ExcepttotheextentthatfundsareotherwiseavailabletotheDistrictto payfortheFacilitiesand/ortopaytheprincipalandinterestasitbecomesdueonbondsof theDistrictissuedtofinancetheFacilities,aspecialtaxsufficienttopaythecoststhereof, securedbyrecordationofacontinuinglienagainstallnon-exemptrealpropertyinthe District,willbeleviedwithintheDistrictandcollectedinthesamemannerasordinaryad valorempropertytaxesorinsuchothermannerasthisCityCouncilshalldetermine, includingdirectbillingoftheaffectedpropertyowners.Theproposedrateandmethodof apportionmentofthespecialtaxamongtheparcelsofrealpropertywithintheDistrict,in sufficientdetailtoalloweachlandownerwithintheDistricttoestimatethemaximumamount suchownerwillhavetopay,aredescribedinExhibitBtotheResolutionofIntention,which Exhibitisbythisreferenceincorporatedherein,andshallbetherateandmethodof apportionmentofspecialtaxesfortheDistrict.ThisCityCouncilherebyfindsthatthebasis forthelevyandapportionmentofthespecialtax,assetforthinsaidrateandmethodof apportionmentofspecialtaxes,isreasonable. 8.TheofficeoftheFinanceDirectoroftheCityofAlameda,2263Santa ClaraAvenue,Alameda,California94501,telephonenumber(510)747-4880,istheoffice oftheCitythatwillberesponsibleforpreparingannuallyandwheneverotherwisenecessary acurrentrollofspecialtaxlevyobligationsbyassessor'sparcelnumberandthatwillbe responsibleforestimatingfuturespecialtaxleviesfortheDistrictpursuanttoSections3-70.32and3-70.71oftheLaw. 9.UponrecordationofanoticeofspecialtaxlienpursuanttoSection3114.5 oftheCaliforniaStreetsandHighwaysCodefortheDistrict,acontinuinglientosecure eachlevyofthespecialtaxshallattachtoallnonexemptrealpropertyintheDistrictandthis lienshallcontinueinforceandeffectuntilthespecialtaxobligationisprepaidand permanentlysatisfiedandtheliencancelledinaccordancewithlaworuntilcollectionofthetaxbytheCityCouncilceases. 10.InaccordancewithSection3-70.36oftheAlamedaMunicipalCode,the appropriationslimit,asdefinedbysubdivision(h)ofSection8ofArticleXIIIBofthe CaliforniaConstitution,oftheDistrictisherebypreliminarilyestablishedat$2,000,000and saidappropriationslimitshallbesubmittedtothequalifiedelectorsoftheDistrictas providedbelow.ThepropositionestablishingtheappropriationslimitfortheDistrictshall becomeeffectiveifapprovedbythequalifiedelectorsoftheDistrictvotingthereonandshall beadjustedinaccordancewiththeapplicableprovisionsofSection3-70.36oftheLaw. 11.PursuanttotheprovisionsofSection3-70.37oftheLaw,theproposition ofthelevyofthespecialtaxandthepropositionoftheestablishmentoftheappropriations limitspecifiedaboveshallbesubmittedtothequalifiedelectorsoftheDistrictatanelection thetime,placeandconditionsofwhichelectionshallbeasspecifiedbyaseparateresolutionofthisCityCouncil. 12.ThisResolutionshalltakeeffectuponitsadoption. ******* I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregularmeeting assembledonthe 7th dayofJanuary,2014,bythefollowingvotetowit: AYES:CouncilmembersChen,Daysog,EzzyAshcraft,Tamand MayorGilmore-5.
