CITYOFALAMEDARESOLUTIONNO.14883 DECLARINGRESULTSOFSPECIALELECTIONANDDIRECTING RECORDINGOFNOTICEOFSPECIALTAXLIEN-ALAMEDALANDING PUBLICIMPROVEMENTS WHEREAS,inproceedingsheretoforeconductedbythisCityCouncil pursuanttotheCityofAlamedaSpecialTaxFinancingImprovementCode,3-70.1etseq. oftheAlamedaMunicipalCode(the"Law"),thisCityCouncilonthisdateadopteda resolution"CallingSpecialElectionWithintheCityofAlamedaCommunityFacilitiesDistrict No.13-1(AlamedaLandingPublicImprovements)",callingforaspecialelectionofthe qualifiedelectorsoftheCityofAlamedaCommunityFacilitiesDistrictNo.13-1(Alameda LandingPublicImprovements)(the"District");and WHEREAS,pursuanttothetermsofsaidResolution,whicharebythis referenceincorporatedherein,thespecialelectionwasheldonthisdate,andtheCityClerk hasonfileaCanvassandStatementofResultsofElection,acopyofwhichisattached heretoasExhibitA;and it.WHEREAS,thisCityCouncilhasreviewedthecanvassandherebyapproves NOW,THEREFORE,BEITRESOLVEDbytheCityCounciloftheCityofAlamedathat: 1.Theissuespresentedatthespecialelectionweretheincurringofa bondedindebtednessinthemaximumaggregateprincipalamountof$20,000,000forthe District,thelevyofaspecialtaxwithintheDistricttobeleviedinaccordancewiththerate andmethodofapportionmentofspecialtaxesfortheDistrictheretoforeapprovedbythis CityCouncilbyitsresolutionadoptedthisdate"OfFormationoftheCityofAlameda CommunityFacilitiesDistrictNo.13-1(AlamedaLandingPublicImprovements),Authorizing LevyofaSpecialTaxWithintheDistrict,PreliminarilyEstablishinganAppropriationsLimit fortheDistrictandSubmittingLevyoftheSpecialTaxandtheEstablishmentofthe AppropriationsLimittotheQualifiedElectorsoftheDistrict,"andtheapprovalofan appropriationslimitfortheDistrictintheamountof$2,000,000. 2.PursuanttothecanvassofthespecialelectiononfilewiththeCityClerk, theissuespresentedatthespecialelectionwereapprovedbythequalifiedelectorsofthe Districtbymorethantwo-thirdsofthevotescastatthespecialelection. 3.Pursuanttothevoterapproval,theDistrictisherebydeclaredtobefully formedwiththeauthoritytoincurbondedindebtednessandtolevyspecialtaxesas heretoforeprovidedintheproceedingstoformtheDistrictandintheLaw. 4.ItisherebyfoundthatallpriorproceedingsandactionstakenbythisCity CouncilwithrespecttotheDistrictwerevalidandinconformitywiththeLaw. 5.TheCityClerkisherebydirectedtoexecuteandcausetoberecordedin theofficeoftheCountyRecorderoftheCountyofAlamedaanoticeofspecialtaxlienfor theDistrictinaformprovidedbyBondCounsel,saidrecordingtooccurnolaterthanfifteen daysfollowingadoptionbytheCityCouncilofthisResolution. 6.ThisResolutionshalltakeeffectuponitsadoption. ******* -2- EXHIBITA CANVASSANDSTATEMENTOFRESULTOFELECTION CITYOFALAMEDA COMMUNITYFACILITIESDISTRICTNO.13-1 (ALAMEDALANDINGPUBLICIMPROVEMENTS) IherebycertifythatonJanuary7,2014,Icanvassedthereturnsofthe specialelectionheldonJanuary7,2014,intheCityofAlamedaCommunityFacilities DistrictNo.13-1(AlamedaLandingPublicImprovements)andthetotalnumberofballots castinsaidelectionandthetotalnumberofvotescastforandagainstthemeasureareas followsandthetotalsasshownforandagainstthemeasurearefull,trueandcorrect: Landowner Votes Votes Cast YES NO CityofAlamedaCommunity FacilitiesDistrictNo.13-1 (AlamedaLandingPublic Improvements)SpecialTaxand BondElectionJanuary7,2014. 24 BALLOTMEASUShalltheCityofAlameda(the"City")incuran indebtednessandissuebondsinoneormoreseriesinthemaximumaggregateprincipal amountof$20,000,000,withinterestatarateorratesnottoexceedthemaximuminterest ratepermittedbylawatthetimeofsaleofsuchbondsonbehalfoftheCityofAlameda CommunityFacilitiesDistrictNo.13-1(AlamedaLandingPublicImprovements)(the "District"),theproceedsofwhichwillbeusedonlytofinancethecostsofcertainpublic improvements(the"Facilities"),asspecifiedintheResolutionofIntentionoftheDistrict,and thecostsofissuingthebonds,initiallyadministeringthebondsandaswellasthe establishmentofappropriatebondreserves;shallaspecialtaxpayablesolelyfromlands withintheDistrictbeleviedannuallyuponlandswithintheDistricttobeappliedtopaythe costsoftheFacilitiesdirectly,topaytheprincipalandinterestonanybondsissuedforthe District,toreplenishthereservesforthebonds,andtopaythecostsoftheCityin administeringtheDistrict;andshalltheinitialannualappropriationslimitoftheDistrictbe establishedintheamountof$2,000,0007 INWITNESSWHEREOF,I HAVEHEREUNTOSETMYHANDthis ih January,2014.
