RESOLUTION NO. 03 -111
AUTHORIZING THE ONE YEAR EXTENSION OF THE EXISTING
TEMPORARY CONSTRUCTION AND ACCESS EASEMENT
BETWEEN THE PORT OF OAKLAND AND THE COMMUNITY
IMPROVEMENT COMMISSION AND FURTHER AUTHORIZING
THE EXECUTIVE DIRECTOR TO EXECUTE UP TO TWO
SUBSEQUENT ONE YEAR EXTENSIONS IF IT CAN BE FOUND
THAT SUCH EXTENSIONS WILL NOT IMPEDE THE
REDEVELOPMENT OF THE FISC /EAST HOUSING PROPERTY
WHEREAS, on March 7, 2000, the Community Improvement Commission
granted the Port of Oakland a two year Temporary Construction and Access Easement
over the former FISC and East Housing Property for the purpose of facilitating the
construction of the Port's -50' Navigation Improvement Project; and
WHEREAS, the -50' Navigation Improvement Project has been delayed because
of delays in the Federal funding process; and
WHEREAS, the timing of future Federal funding remains uncertain; and
WHEREAS, the existing Temporary Construction and Access Easement will
expire in July of 2003; and
WHEREAS, the Community Improvement Commission has, in the Agreement
Regarding the Oakland Harbor Navigation Improvement Proiect ( -50) agreed to
reasonably cooperate with the Port of Oakland to facilitate the construction of the harbor
improvements.
NOW, THEREFORE, BE IT RESOLVED that the Community Improvement
Commission hereby authorizes the Executive Director of the Community Improvement
Commission to execute a one -year extension of the existing Temporary Construction and
Access Easement between the Community Improvement Commission and the Port of
Oakland.
BE IT FURTHER RESOLVED that the Community Improvement Commission
authorizes the Executive Director to execute, at his discretion, up to two additional one -
year extensions of the Temporary Construction and Access Easement, if requested by the
Port of Oakland, and if the Executive Director determines that such additional one -year
extensions will not impede the redevelopment of the FISC or East Housing properties.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Community Improvement Commission of the City of Alameda in a
Special Community Improvement Commission meeting assembled on the 15th day of April, 2003, by
the following vote to wit:
AYES: Commissioners Daysog, DeWitt, Kerr, Matarrese and
Chair Johnson - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
