RESOLUTION NO. 0 3 -118
SUPPORTING THE CITY COUNCIL'S "FISCAL NEUTRALITY"
POLICY BY COMMITTING FISC LEASE REVENUES
TO SUPPORT MUNICIPAL SERVICES FOR DEVELOPMENT
OF THE FLEET INDUSTRIAL SUPPLY CENTER AND
BAYPORT RESIDENTIAL DEVELOPMENT
WHEREAS, on November 4, 2003, the City Council of the City of Alameda adopted a
policy of "fiscal neutrality" regarding development at Alameda Point and the Fleet Industrial
Supply Center ( "FISC "); and
WHEREAS, pursuant to a Disposition and Development Agreement between the
Community Improvement Commission ( "CIC ") and Catellus Development Corporation, a
residential development of approximately 485 homes, known as "Bayport," will be constructed at
the former FISC/East Housing property; and
WHEREAS, in order to fund the provision of municipal services necessitated by the
Bayport project, including but not limited to, public safety services, and maintenance of public
infrastructure and a public park, the Bayport Community Facilities District was established by
City Council Resolution on November 4, 2003; and
WHEREAS, in recognition of the City Council's "fiscal neutrality" policy, it is intended
that the Bayport residential project will create enough revenues to the City's General Fund, that,
with the inclusion of special assessments through the Bayport Community Facilities District, the
Bayport project will fully support the cost to the City of Alameda of providing municipal services,
including, but not limited to, public safety, and maintenance of public infrastructure and a public
park.
NOW THEREFORE, the Community Improvement Commission of the City of Alameda
resolves that:
In the event that the revenues to the City of Alameda General Fund from the Bayport
residential project, coupled with the special assessments from the Bayport residential
development, are insufficient to fully pay for the City's costs of providing necessary municipal
services to the Bayport project, then the CIC shall commit lease revenues from its commercial
leases in the FISC to the City's General Fund for the purpose of filling the "gap" in the City's
costs of providing municipal services to the Bayport Development project.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Community Improvement Commission of the City of Alameda in a
Special Joint City Council, Community Improvement Commission and Housing Authority Board of
Commissioners meeting assembled on the 4th day of November, 2003, by the following vote to wit:
AYES: Commissioners Daysog, Gilmore, Kerr, and Chair Johnson - 4.
NOES: None.
ABSENT: Commissioner Matarrese - 1.
ABSTENTIONS: None.
