RESOLUTION NO. 85-26
APPROVING AND AUTHORIZING THE EXECUTION OF AN
AFFORDABLE HOUSING AGREEMENT BETWEEN THE COMMUNITY
IMPROVEMENT COMMISSION AND ALAMEDA MARINA VILLAGE
ASSOCIATES AND ALAMEDA MARINA CENTER ASSOCIATES
WHEREAS, the City Council of the City of Alameda adopted
and approved a certain Plan (the Plan of the West End Community
Improvement Project area) for the West End Community Improvement
Project by Ordinance No. 2141, N.S., on July 5, 1983; and
WHEREAS, Alameda Marina Village Associates (AMVA) and
Alameda Marina Center Associates (AMCA) own certain property
located within the Project Area and intend to develop the
property pursuant to the Marina Village Master Plan Revision,
dated July 23, 1984; and
WHEREAS, in furtherance of the Project, the City and the
Commission entered into City Cooperation and Owner Participation
Agreements with AMVA and AMCA which provide for cooperation in
ensuring the construction and/or acquisition of on- and off-site
public improvements, as well as provision for affordable housing
for the Project Area; and
WHEREAS, the West End Community Improvement Project Plan
includes housing goals for the Project Area; and
WHEREAS, the State Redevelopment Law as described in
Section 33334.2 of the California Health and Safety Code requires
that 20% of the total tax increment collected from the Project
Area be placed in a housing set-aside fund to be used for providing
housing opportunities for low and moderate income families; and
WHEREAS, the Owner Participation Agreement in Section 7.5
set forth a provision that provides for the valid use of the 20%
housing set-aside fund and further requires AMVA and AMCA to
submit within five years a proposal(s) for the valid use of the
housing set-aside; and
WHEREAS, AMVA and AMCA have submitted an Affordable
Housing Plan in accordance with the State Redevelopment Law
requirements and the Owner Participation Agreement requirements.
NOW, THEREFORE, BE IT RESOLVED by the Community
Improvement Commission of the City of Alameda that the Community
Improvement Commission finds and determines that the Affordable
Housing Agreement as submitted meets the City's housing goals and
objectives as described in the West End Community Improvement
Plan and also meets the requirements set forth in Section 7.5 of
the Owner Participation Agreement, and hereby approves and
authorizes execution of an Affordable Housing Agreement and the
Chairman and Secretary are hereby authorized and directed to
execute and to attest to respectively, said Agreement on behalf
of the Community Improvement Commission.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly adopted and passed by the Community Improvement Commission of
the City of Alameda in a regular meeting assembled on the 17th of September, 1985,
by the following vote, to wit:
AYES: Commissioners Corica, Hanna, Lucas, Monsef and Chairman Diament - 5.
NOES: None.
ABSENT: None..
