RESOLUTION NO. 98-75
DETERMINING THE NEED TO ADOPT A COMMUNITY IMPROVEMENT PLAN FOR
THE ALAMEDA POINT IMPROVEMENT PROJECT AND DELAY APPLICATION OF
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, pursuant to Health and Safety Code Sections 33492 and
33493.1 of the Community Redevelopment Law (the "Special Base Closure
Legislation"), the Community Improvement Commission of the City of
Alameda (the "CIC") has prepared the Community Improvement Plan (the
"Plan") for the Alameda Point Improvement Project (the "Project"); and
WHEREAS, Section 33492.18 of the Special Base Closure Legislation
authorizes a redevelopment agency to delay the application of the
provisions of the California Environmental Quality Act (Public Resources
Code Section 21000, et seq. ("CEQA") if the redevelopment agency finds
and determines at a public hearing noticed in accordance with the
provisions of Section 33492.18(d) of the Special Base Closure Legislation
that the need to adopt a redevelopment plan at the soonest possible time
in order to use the authority in the Special Base Closure Legislation
requires the redevelopment agency to delay application of CEQA; and
WHEREAS, notice of the CIC's intention to consider and act upon a
determination that the need to adopt a redevelopment plan at the soonest
possible time in order to use the authority in the Special Base Closure
Legislation requires the CIC to delay application of CEQA to the adoption
of the Plan was published and mailed in accordance with Section 33492.18
of the Special Base Closure Legislation; and
WHEREAS, the CIC held a public hearing on February 17, 1998, to
consider whether the need to adopt the Plan at the soonest possible time
in order to use the authority in the Special Base Closure Legislation
required the CIC to delay application of CEQA to the adoption of the
Plan.
NOW, THEREFORE, THE COMMUNITY IMPROVEMENT COMMISSION OF THE CITY
OF ALAMEDA DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The CIC held a public hearing and considered the need to
adopt the Plan as soon as possible and to delay the application of CEQA
to the adoption of the Plan.
Section 2. The CIC hereby finds and determines that the need to
adopt the Plan at the soonest possible time in order to use the authority
in the Special Base Closure requires the delay of the application of CEQA
to the adoption of the Plan. This finding is based on the fact that in
order for the Plan to be in effect prior to the disposition of property
by the federal government to enable the CIC to financially assist the
redevelopment of the Project Area and in order to make the Plan
financially feasible, it is necessary for the Plan to be in effect at the
earliest possible time and prior to the completion of the environmental
review.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the
Community Improvement Commission of the City of Alameda in special
meeting assembled on the 17th day of February , 1998, by the
following vote to wit:
AYES: Commissioners Daysog, DeWitt, Kerr, Lucas
and Chair Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
