RESOLUTION NO. 98-76
SUPPORTING SENATE BILL 1615 EXTENDING THE DEADLINE FOR
CERTIFYING AN ENVIRONMENTAL IMPACT REPORT FOR THE ALAMEDA
POINT IMPROVEMENT PROJECT REDEVELOPMENT PROJECT
WHEREAS, on February 17, 1998, the City Council of the City of
Alameda held a public hearing noticed in accordance with the provisions
of Section 33492.18(d) of the Special Base Closure Legislation and
introduced an ordinance adopting the Alameda Point Improvement Project
(APIP) redevelopment project; and
WHEREAS, in accordance with California Health and Safety Code
Section 33492.18, the CIC found and determined the need to delay the
certification of an environmental impact report (EIR) on the APIP; and
WHEREAS, California Health and Safety Code Section 33492.18 provides
that until an EIR for the APIP is certified, individual projects are
subject to normal application of California Environment Quality Act
(CEQA) requirements; and
WHEREAS, the CIC seeks to utilize much of the technical data and
mitigation program presented in the environmental impact report on the
disposal and reuse of Naval Air Station Alameda and the Fleet Industrial
Supply Center/Alameda Annex (Navy EIR) currently being prepared by the
U.S. Department of the Navy; and
WHEREAS, the Navy EIR was originally scheduled to be completed in
mid-1997; and
WHEREAS, the U.S. Department of the Navy has indicated additional
delays in scheduled certification of the EIR until at least early 1999;
and
WHEREAS, CIC has no control over the schedule of completion of the
Navy EIR; and
WHEREAS, in the absence of an extension in time to certify an EIR,
and in order to comply with existing law, the CIC would be required
either to initiate environmental analysis that is duplicative of the
Navy's environmental analysis, or to delay entering into agreements that
implement the Community Improvement Plan for the APIP; and
WHEREAS, Senate Bill 1615, which has been introduced by Senator
Barbara Lee and Cc-authored by Assemblyman Don Perata, would extend the
deadline to certify an EIR from 18 months to 30 months.
NOW, THEREFORE, THE COMMUNITY IMPROVEMENT COMMISSION OF THE CITY
OF ALAMEDA DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The Community Improvement Commission of the City of
Alameda supports Senate Bill 1615 extending the deadline for
certification of an environmental impact report for the Alameda Point
Improvement Project.
I, the undersigned, hereby certify that the foregoing
Resolution was duly and regularly adopted and passed by the
Community Improvement Commission of the City of Alameda in special
meeting assembled on the 3rd day of March , 1998, by the
following vote to wit:
AYES: Commissioners Daysog, DeWitt, Kerr, Lucas
and Chair Appezzato - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
