RESOLUTION NO. 99 -83
APPROVING THE EXPENDITURE OF FUNDS FROM THE
BWIP LOW AND MODERATE INCOME HOUSING FUND IN
THE APIP AND AGGREGATING THE HOUSING UNITS
REQUIRED PURSUANT TO SECTION 33413(b) IN THE BWIP
AND APIP
WHEREAS, the Community Improvement Commission of the City of
Alameda (the "CIC ") is in the process of carrying out the Community
Improvement Plans for both the Business and Waterfront Improvement
Project ( "BWIP ") and the Alameda Point Improvement Plan ( "APIP ")
pursuant to the California Community Redevelopment Law ( "CRL ") (Health
and Safety Code Section 33000 et seq.); and
WHEREAS, the United States of America, acting through the
Department of the Navy of the Department of Defense (the "Navy ") has
declared the Naval Air Station, Alameda, California (the "Naval Air Station ")
surplus to federal needs pursuant to certain federal military installation
closure and realignment laws; and
WHEREAS, the Alameda Reuse and Redevelopment Authority
( "ARRA ") was formed as the local reuse authority to accept conveyance of the
Naval Air Station and to address the reuse and redevelopment of the Naval
Air Station, now known as "Alameda Point;" and
WHEREAS, the Base Closure Community Redevelopment and
Homeless Assistance Act of 1994 (the "Act ") requires that military bases that
are being closed make reasonable accommodations to meet the needs of the
homeless; and
WHEREAS, APIP was adopted by the City of Alameda ( "City ") to assist
in the redevelopment of Alameda Point including, but not limited to, the
provision of housing for low and moderate income persons including, but
not limited to, the homeless; and
WHEREAS, ARRA has adopted a Reuse Plan for Alameda Point which
provides appropriate accommodations for the rehabilitation and reuse of
existing housing units for the homeless; and
WHEREAS, ARRA (with City as its successor in interest) intends to
enter into separate agreements with providers of specific housing projects
such as University Avenue Housing, Inc. and Operation Dignity, Inc.
( "Homeless Providers "), which will govern the scope of the project and
specify eligible uses of designated housing funds; and
WHEREAS, Section 33334.2(g) of the Health and Safety Code authorizes
the use of Low and Moderate Income Housing Funds ( "Housing Funds ")
outside the project area but within the City upon a finding by the CIC and the
City that the use will be of benefit to the project; and
WHEREAS, Section 33413(b)(2)(A)(v) of the Health and Safety Code
authorizes the CIC to aggregate in one or more project areas the number of
new and substantially rehabilitated housing units required pursuant to
Section 33413(b) of the Health and Safety Code and the CIC desires to aggregate
the number of required units in the BWIP and APIP project areas.
NOW, THEREFORE, THE COMMUNITY IMPROVEMENT
COMMISSION OF THE CITY OF ALAMEDA DOES HEREBY RESOLVE AS
FOLLOWS:
Section 1. The CIC hereby finds and determines that the use of
funds from both the BWIP Low and Moderate Income Housing Fund (Fund
#204) and the BWIP Inclusionary In Lieu Fund (Fund No. 204.5) to provide
housing for the homeless to be rehabilitated and managed by the Homeless
Providers in the APIP will be of benefit to the BWIP project and will assist in
the implementation of the goals of the BWIP project. Based upon this
finding, the CIC hereby authorizes the expenditure of these funds in order to
provide affordable housing for the formerly homeless within the APIP
pursuant to individual agreements with the Homeless Providers.
Section 2. The CIC hereby finds and determines that the aggregation of
new and substantially rehabilitated units required by Section 33413(b) in the
BWIP and APIP will assist in the implementation of the goals of both the
BWIP and APIP and will not cause or exacerbate racial, ethnic, or economic
segregation. Based upon this finding, the CIC hereby approves the
aggregation of the, number of new and substantially rehabilitated units
required by Section 33413(b) in the BWIP and APIP.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
adopted and passed by the Community Improvement Commission of the City of Alameda in special
meeting assembled on the 6th day of October . 1999, by the following vote to wit:
AYES: Commissioners Daysog, DeWitt, Johnson, and
Chair Appezzato - 4.
NOES: Commissioner Kerr - 1.
ABSENT: None.
ABSTENTIONS: None.
