APPOINTING AN ENGINEER AND AN ATTORNEY FOR CITY OF
ALAMEDA MAINTENANCE ASSESSMENT DISTRICT 01 -1,
(MARINA COVE)
WHEREAS, by its previous proceedings, the City Council of the City of Alameda
determined to undertake the formation of the first maintenance assessment district within
the City of Alameda Maintenance Assessment District 01 -1 (hereinafter the "District ")
pursuant to the provisions of Chapter 3, Article V of the Alameda Municipal Code (the City
of Alameda Maintenance Procedure Code) (hereinafter the "Code"), which also
incorporates the procedural requirements of the Landscape and Lighting Act of 1972
(hereinafter the "Act "); and
WHEREAS, sections 22620 et seq. of the Act provide for the levy of annual
maintenance assessments after formation of the District; and
WHEREAS, the purpose of said assessments is to provide for enhanced
maintenance in the zones established within said District described in proceedings in and
for said District heretofore approved by this Council and herein incorporated by this
reference; and
WHEREAS, the public interest and convenience will be served by appointing an
Engineer -of -Work and an Attorney -of- Record for assessment and legal services; and
WHEREAS, it would be advantageous to the City to continue with the services of
the City Engineer as the Engineer -of -Work and the City Attorney as the Attorney for said
District.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that
the City Engineer for the City of Alameda is hereby appointed as Engineer -of -Work for the
purpose of preparing the assessment diagram and the assessment amount, by parcel,
within the zones of the City of Alameda Maintenance Assessment District 01 -1; and
BE IT FURTHER RESOLVED that the City Attorney for the City of Alameda is
hereby appointed as Attorney -of- Record to perform the legal services required in the
conduct of said proceedings.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in regular meeting
assembled on the 18th day of February, 2014, by the following vote to wit:
AYES: Councilmembers Chen, Daysog, Ezzy Ashcraft, Tam and
Mayor Gilmore — 5.
