CITYOFALAMEDARESOLUTIONNO.14794 DECLARINGTHATFREEDOMFROMDOMESTICVIOLENCE ISAFUNDAMENTALHUMANRIGHT WHEREAS,theCityCouncilofAlameda,Californiaseekstoenhancethepublic welfarebydeclaringthattheprotectionagainstdomesticviolenceisafundamental humanright;and WHEREAS,survivorsofdomesticviolencemustdealwiththeeffectsofphysical injuries,long-termpsychologicaldamage,financialinstability,andtroublefindingsafe housing;and WHEREAS,morethan1in3womenandmorethan1in4menintheUnited Stateswillexperiencerape,physicalviolence,and/orstalkingbyanintimatepartnerat somepointintheirlives;andintheCityofAlamedathisproblemdisproportionately impactswomenofcolor,womenwithdisabilities,womenwithlowincome,and immigrantwomenaswellastheirchildren;and WHEREAS,the700domesticviolenceoffensesreportedintheCityofAlameda from2008through2012constituted29%ofallreportedviolentcrimesandresultedin 525arrests;and WHEREAS,whileitisimpossibletoadequatelyprojectthenumberofunreported domesticviolencecasesinAlameda,officersrespondingtodomesticviolencecallsask thevictimiftherehasbeenanypriordomesticviolenceintherelationship,anditisnot uncommonforvictimstodisclosepriorunreportedcasesofdomesticviolence;and WHEREAS,inmanycases,traumatizedchildrenarethesilentvictimsinhomes wheredomesticviolenceoccurs;and WHEREAS,everynewAlamedaPoliceDepartmentofficerreceivesaminimum of10hourstrainingindomesticviolenceduringthebasicacademyandcontinued trainingthroughouttheircareerwiththedepartment,andSchoolResourceOfficers provideclassroominstructionatthehighschoolsandatGirlsInc.on<domesticviolence, datingviolence,andcrimereporting;and WHEREAS,in2011,theInter-AmericanCommissiononHumanRightsfoundin JessicaLenahan(Gonzales)v.UnitedStatesthattheUnitedStates'failuretoprotect womenfromgender-basedviolenceconstitutesdiscriminationand a humanrights violation,andurgedtheUnitedStatestoenactlawandpolicyreformstoprotectvictims ofdomesticviolenceandtheirchildren;and WHEREAS,worldandUnitedStatesrecognizethatdomesticviolenceisa humanrightsconcern;andpoliceandsheriff'sdepartments,courts,counties,cities, socialserviceagencies,andotherlocalgovernmententitiesconstitutethefirstlineof defenseagainstdomesticviolence;and WHEREAS,eachyear,theCityofAlamedarecognizesOctoberasDomestic ViolenceAwarenessMonth,and,throughitsSocialServiceHumanRelationsBoard, hasconvenedaDomesticViolenceTaskForcewhosepurposeisto"coordinate domesticviolencepreventionandinterventionservicesintheCityofAlameda andmobilizeallmembersofourcommunitytotakeapro-activeroleinbuildinga domesticviolence-freecommunity";and WHEREAS,BuildingFuturesforWomenandChildren,anon-profitwhich operatesMidwayWomen'sShelterandBessieColemanCourtHousing,whichare prioritizedtoservebatteredwomenandtheirchildren,theAlamedaPoliceDepartment, AlamedaHospital,FamilyViolenceLawCenter,AlamedaFamilyServices,Alameda PointCollaborative,andAlameda'sSocialServiceHumanRelationsBoard,havejoined andarededicatedtothemissionoftheDomesticViolenceTaskForce,and WHEREAS,byrecognizingthatfreedomfromdomesticviolenceisahuman rightsissue,theCityofAlamedawillraiseawarenessandenhancedomesticviolence educationincommunities,thepublicandprivatesectors,andwithingovernment agencies, NOW,THEREFORE,BEITRESOLVEDbytheAlamedaCityCouncilthat 1.ThisResolutionshallserveasadeclarationtoassurethattheCityofAlameda recognizesandbearsamoralresponsibilitytosecurethishumanrightonbehalf ofourresidents. 2.ThisResolutionshallserveasencouragementtoalldepartmentsoftheCityof Alameda,andotheragenciesandnon-profitorganizationsinAlameda,to incorporatetheseprincipleswithintheirpoliciesandpractices. 3.AcopyofthisResolutionbe sent-to theAlamedaCountyBoardofSupervisors, theAlamedaCountyDistrictAttorney,theAttorneyGeneralfortheStateof California,andtheMayorsandCouncilmembersofeachmunicipalitywithin AlamedaCounty,accompaniedbyaletterencouragingthemtoconsider passingasimilarresolution. ****** I,theundersigned,herebycertifythattheforegoingResolutionwasdulyand regularlyadoptedandpassedbytheCounciloftheCityofAlamedainaregular meetingassembledonthe16th dayofApril,2013,bythefollowingvote,towit: AYES:CouncilmembersChen,Daysog,EzzyAshcraft,Tamand MayorGilmore-5.
