CITY OF ALAMEDA RESOLUTION NO. 14801
AUTHORIZING THE CITY MANAGER TO SUBMIT A VEHICLE
REGISTRATION FEE PEDESTRIAN AND BICYCLIST ACCESS AND
SAFETY PROGRAM AND MEASURE B BICYCLE/PEDESTRIAN
COUNTYWIDE DISCRETIONARY FUND GRANT APPLICATION TO
THE ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR
$793,000 TO DESIGN AND CONSTRUCT THE CROSS ALAMEDA
TRAIL ALONG RALPH APPEZZATO MEMORIAL PARKWAY BETWEEN
WEBSTER STREET AND POGGI STREET, TO COMMIT $200,000 IN
CITYWIDE DEVELOPER FEES AS A LOCAL MATCH, AND TO
EXECUTE ALL NECESSARY DOCUMENTS
WHEREAS, the City of Alameda (“APPLICANT”) has submitted an application to
the Alameda County Transportation Commission (“ACTC”) for $793,000 from the
following funding sources administered by the ACTC and programmed at Alameda
CTC’s discretion as part of the ACTC FY12-13 Coordinated Program (“PROGRAM”):
Measure B Bicycle/Pedestrian Countywide Discretionary Fund and Vehicle Registration
Fee (VRF) Pedestrian and Bicyclist Access and Safety Program (collectively, “FY12-13
COORDINATED PROGRAM FUNDING”) for the Cross Alameda Trail (“PROJECT”);
and
WHEREAS, the PROJECT will include design and construction of the Cross
Alameda Trail along Ralph Appezzato Memorial Parkway between Webster Street and
Poggi Street. This FUNDING will design and construct a Class I path along this
segment of an abandoned railroad right-of-way, which is now owned by the
APPLICANT, and will provide connections to Fifth Street and West Campus Drive as
well as landscaping/urban runoff control; and
WHEREAS, the PROJECT is a high-priority project in the APPLICANT’s Bicycle
Master Plan Update (2010), a medium-priority in the APPLICANT’s Pedestrian Plan
(2009) and is on the APPLICANT’s Implementation List for Competitive Grants and
Regional Funding (2013); and
WHEREAS, the APPLICANT represents that the APPLICANT is an eligible grant
recipient for such Measure B or VRF funds.
NOW, THEREFORE, BE IT RESOLVED that the APPLICANT is authorized to
enter into a funding agreement for FY12-13 COORDINATED PROGRAM FUNDING for
the PROJECT.
BE IT FURTHER RESOLVED that the APPLICANT by adopting this resolution
does hereby confirm and agree that:
1. The City manager is authorized to submit a Vehicle Registration Fee
Pedestrian and Bicyclist Access and Safety Program and Measure B
Bicycle/Pedestrian Countywide Discretionary Fund Grant Application to the
Alameda County Transportation Commission for $793,000 to design and
construct the Cross Alameda Trail along Ralph Appezzato Memorial Parkway
between Webster Street and Poggi Street, to Commit $200,000 in Citywide
Developer Fees as a Local Match, and to Execute All Necessary Documents;
and
2. APPLICANT will provide $200,000 in matching funds; and
3. APPLICANT understands that the amount of FY12-13 COORDINATED
PROGRAM FUNDING for the PROJECT is capped at the amount approved
by the ACTC, and that any cost increases must be funded by the APPLICANT
from other funds, and that APPLICANT does not expect any cost increases to
be funded with additional Measure B/VRF grant funding; and
4. PROJECT will be implemented as described in the application, grant funding
agreement and in this resolution; and
5. APPLICANT and the PROJECT will comply with the requirements as set forth
in the PROGRAM Guidelines and grant funding agreement.
BE IT FURTHER RESOLVED that the APPLICANT is an eligible sponsor of
Measure B or VRF funded projects.
BE IT FURTHER RESOLVED that there is no pending or threatened litigation
that might in any way adversely affect the proposed PROJECT, or the ability of the
APPLICANT to deliver such PROJECT.
BE IT FURTHER RESOLVED that the APPLICANT authorizes its City Manager
or other appropriate designee to execute a funding agreement with ACTC for FY12-13
COORDINATED PROGRAM FUNDING and any other necessary documents for the
PROJECT as referenced in this Resolution.
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to
ACTC by June 30, 2013.
