AUTHORIZING RENEWAL AND ASSIGNMENT OF TIDAL CANAL
LICENSE AGREEMENTS FOR GERALD D. LOOMIS,
3363 FERNSIDE BOULEVARD AND A. WILLIAM BODLE,
STONE BOAT YARD, 2517 BLANDING AVENUE
WHEREAS, two adjacent property owners have requested
renewal or assignment of Army Corps of Engineers licenses; and
WHEREAS, on September 3, 1986 by its Ordinance No. 2303
N.S., this Council authorized the transfer of all tidal canal
leases to the City of Alameda from the Army Corps of Engineers;
WHEREAS, Gerald D. Loomis, 3363 Fernside Boulevard,
desires to renew and extend his license for use of certain
government -owned land and water areas, for purposes of
maintenance and operation thereon of dock facilities, by entering
into a lease with the City of Alameda for the property adjacent
to Assessor's Parcel No. 69- 109 -184, as described in the form of
lease referred to hereinbelow and for term of twenty -five (25)
years; and
WHEREAS, A. William Bodle, owner of Stone Boat Yard,
2517 Blanding Avenue, desires the transfer of a license fro
Kenneth Murray, Jr., former owner of the Sailboat Shop, for use
of certain government -owned tidal canal property, for purposes of
maintenance and operation thereon of dock facilities, by entering
into a lease with the City of Alameda for the property abutting
the Fernside Shopping Center, as described in the form of lease
referred to hereinbelow and for a term of twenty -five (25) years;
and
WHEREAS, the Council of the City of Alameda finds and
determines that the use of the property proposed to be leased
will be in the best interests of the City of Alameda; and
WHEREAS, forms of leases containing the covenants and
agreements to be agreed upon by and between the City and Gerald D.
Loomis and A. William Bodle have been prepared and submitted to
this Council and filed with the Clerk of said City, and said
Council is aware of and approves the contents thereof;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Alameda that:
Section 1. The form of lease referred to in the
preamble hereinabove, between Gerald D. Loomis and the City of
Alameda, and the terms, conditions, covenants and agreements
contained therein be, and the same hereby are, approved.

Section 2. The Mayor be, and he hereby is, authorized to
execute, for and on behalf of the City of Alameda, a lease of
said lands to Gerald D. Loomis, said lease to be substantially
in the form and containing the terms, conditions, covenants and
agreements set forth in said form of lease, and the City Clerk is
hereby directed to attest the same.
Section 3. The form of lease referred to in the preamble
hereinabove, between A. William Bodle and the City of Alameda,
and the terms, conditions, covenants and agreements contained
therein be, and the same hereby are, approved.
Section 4. The Mayor be, and he hereby is, authorized to
execute, for and on behalf of the City of Alameda, a lease of
said lands to A. William Bodle, said lease to be substantially
in the form and containing the terms, conditions, covenants and
agreements set forth in said form of lease, and the City Clerk is
hereby directed to attest the same.
Section 5. This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.
