Ordinance 2359CITY OF ALAMEDA ORDINANCE NO. 2359 New Series EXTENDING INTERIM ORDINANCE NO. 2350 N.S., PROHIBITING AND SUSPENDING ISSUANCE OF BUILDING PERMITS FOR CONSTRUCTION ON CERTAIN PROPERTIES LOCATED AT GIBBONS DRIVE, FERNSIDE BOULEVARD AND HIGH STREET, THAT ARE INCONSISTENT WITH PROPOSED ZONING WHEREAS, the Council of the City of Alameda adopted Interim Ordinance No. 2350 N.S. on July 7, 1987; and WHEREAS, Interim Ordinance No. 2350 N.S. will expire on August 21, 1987; that: BE IT ORDAINED by the Council of the City of Alameda Section 1. From and after the effective date of this ordinance, Interim Ordinance No 2350 N.S. declaring that there shall be no building permits issued by the City which may be in conflict with any uses in an R -1 District for the properties located within the C -1 zone at the corner of Fernside Boulevard and Gibbons Drive shall be extended for a period of three months. Section 2. This ordinance is one of great necessity and urgency within the meaning of Section 3 -12 of the City Charter and Section 65858 of the California Government Code, is introduced and passed at the same Council meeting, and shall become effective on December 3, 1986. Section 3. The facts constituting the necessity and urgency hereof are: (1) The City Council has ordered a study of this location for residential zoning. (2) The building permit could be issued prior to the time the Planning Board has to consider the rezoning. (3) If a building permit is issued the rezoning will be ineffective. (4) Development of this parcel inconsistent with Ordinance 2350 N.S. is a threat to the public welfare. 1 Section 4. This Council hereby finds, determines and declares that it is in the best public interest and necessity that this ordinance be introduced and passed at the regular meeting of the City Council held August 18, 1987, and that this ordinance become and be in full force and effect on August 18, 1987. 2 Presiding Officer of the Council I, the undersigned, hereby certify that the foregoing Ordinance was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 18th of August, 1987, by the following vote to wit: AYES: Councilmembers Camicia, Haugner, Monsef, Thomas and President Corica - 5.
