Ordinance 2363that: CITY OF ALAMEDA ORDINANCE NO. 2363 New Series AMENDING VARIOUS SECTIONS OF CHAPTER 1, TITLE XI OF THE ALAMEDA MUNICIPAL CODE RELATING TO REGULATIONS FOR THE R-2 THROUGH R-6 ZONES, AND NON-CONFORMING USES BE IT ORDAINED by the Council of the City of Alameda Section 1. The Alameda Municipal Code is hereby amended by deleting Sections 11-126 and 11-1217 of Article 1 of Chapter 1 of Title XI thereof. Section 2. The Alameda Municipal Code is hereby amended by deleting Subsections (1), (2), (3), (4) and (5) of Section 11-1312 (h); Subsections (1), (2), (3), (4) and (5) of Section 11-1316 (h), Subsection (b) of Section 11-1319 and Subsections (1), (2), (3), (4) and (5) of Section 11-1320 (h) of Article 3 of Chapter 1 of Title XI thereof. Section 3. The Alameda Municipal Code is hereby amended by adding Section 11-154.5 to Article 1 of Chapter 1 of Title XI thereof to read: Sec. 11-154.5. Restoration of Destroyed Residential Buildings. Section 11-154 notwithstanding, any damaged or destroyed structure containing three or more dwelling units [Sec. 11-421 (g)] may be rebuilt to its existing density as provided by Section 11-443. Section 4. The Alameda Municipal Code is hereby amended by amending Section 11-114 of Article 1 of Chapter 1 of Title XI thereof to read: 9/15/87 Sec. 11-114. Designation of Districts. The several classes of General Districts hereby provided, and into which the City may be divided, are designated as follows: Map Symbol R-1 One-Family Residence District R-2 Two-Family Residence District R-3 Garden Residential District R-4 Neighborhood Residential District R-5 General Residential District R-6 Hotel-Residential District AP Administrative-Professional District C-1 Neighborhood Business District C-2 Central Business District 1 C-M Commercial-Manufacturing District M-1 Intermediate Industrial (Manufacturing) District M-2 General Industrial (Manufacturing) District MX Mixed Use Planned Development District 0 Open Space District Section 5. The Alameda Municipal Code is hereby amended by amending Section 11-1229.2 of Article 2 of Chapter 1 of Title XI thereof to read: Sec. 11-1229.2. "Multiple House". A residential building used as condominium units, planned development units, stock cooperative, a limited equity cooperative or other real estate development as those terms are defined in Division 2, Title 7 of the Government Code or in the Civil Code of the State of California. Section 6. The Alameda Municipal Code is hereby amended by amending Sections 11-132 (a), 11-136 (a), 11-138 (a), 11-139, 11-1310 (a), 11-1311 (b), 11-1312 (a), 11-1313, 11-1314 (a), 11-1315 (a), 11-1316 (a) and (h), 11-1317, 11-1318 (a), 11-1320 (a) and (h), 11-1321 and 11-1324 (a) of Article 3 of Chapter 1 of Title XI thereof to read: Sec. 11-132. Uses Permitted. (a) One-family dwellings, including private garages, accessory buildings and uses; reconstruction of destroyed two-family dwellings, provided that all zoning requirements other than density shall be met and that any requirement that would reduce the number or size of the units shall not apply; private, non-commercial swimming pools, boat landings, docks, piers and similar structures; and home occupations upon compliance with the standards as set forth in Section 11-1222 to the satisfaction of the Planning Director. Upon the approval of the Planning Director, a "Registration of Home Occupation" form shall be completed and filed with the Planning Department. Any property owner aggrieved by the approval or non-approval of the Planning Director shall have the right to appeal such action to the City Planning Board in the manner and within the time limits set forth in Section 11-192 of this Code. Nothing contained herein shall be deemed to deny the right of appeal under said Section 2 11-192 following the determination of the City Planning Board. Sec. 11-136. Uses Permitted. (a) Any number of one-family dwellings, two-family dwellings, and combinations thereof, when separated by a distance not less than 20 feet; and uses permitted in R-1 Districts. Sec. 11-138. Minimum Height, Bulk and Space Requirements. (a) Lot area: Not less than five thousand (5,000) square feet in all lots recorded on and after the effective date of this Chapter, August 1, 1958. However, regardless of date of recordation, there shall be not less than two thousand (2,000) square feet of lot area for each dwelling unit, except in the case of Multiple House where there shall be not less than two thousand five hundred (2,500) square feet of lot area for each dwelling unit. Sec. 11-139. General. The following specific regulations and the general rules set forth in Article 4-A shall apply in all R-3 Districts, as delineated and described in the Zoning Map(s). It is intended that this district classification be applied in areas where one-family and two-family, and groups of such structures, may be located to preserve low density standards. Sec. 11-1310. Uses Permitted. (a) Uses permitted in R-1 and R-2 Districts. Sec. 11-1311. Uses Requiring Use Permits. (b) Public parks, public and private schools, playgrounds, public buildings, nursery schools, daycare centers and churches. Sec. 11-1312. Minimum Height, Bulk and Space Requirements. (a) Lot Area: Not less than five thousand (5,000) square feet in all lots recorded on and after the effective date of this Chapter, August 1, 1958. However, 3 regardless of date of recordation, there shall be not less than two thousand (2,000) square feet of lot area for each dwelling unit. Section 11-1313. General. The following specific regulations and the general rules set forth in Article 4-A shall apply in all R-4 Districts as delineated and described in the Zoning Map(s). It is intended that this district classification be applied in areas where one-family and two-family homes, groups of one and two-family homes, and certain non-profit organization administration offices, if found compatible, may be located to promote low density, primarily residential standards. Sec. 11-1314. Uses Permitted. (a) Uses permitted in R-1, R-2 and R-3 Districts. Sec 11-1315. Uses Requiring Use Permits. (a) Uses not otherwise permitted in Sec. 11-1314 and as required in R-3 districts. Sec. 11-1316. Minimum Height, Bulk and Space Requirements. (a) Lot Area: Not less than five thousand (5,000) square feet in all lots recorded on and after the effective date of this Chapter, August 1, 1958. However, regardless of date of recordation, there shall be not less than one thousand five hundred (1,500) square feet of lot area for each dwelling unit. (h) Distances Between Main Buildings on Same Lot: 20 feet. Sec. 11-1317. General. The following specific regulations and the general rule set forth in Article 4-A shall apply in all R-5 Districts, as delineated and described in the Zoning Map(s). It is intended that this district classification be applied in areas where one and two-family homes, public buildings, institutions and certain office uses, if found compatible, may be located to promote low density standards and promote a mix of uses. 4 Sec. 11 -1318. Uses Permitted. (a) Uses permitted in R -1, R -2, R -3 and R -4 Districts. Sec. 11 -1320. Minimum Height, Bulk and Space Requirements. (a) Lot Area: Not less than five thousand (5,000) square feet in all lots recorded on and after the effective date of this Chapter, August 1, 1958. However, regardless of date of recordation, there shall be not less than one thousand (1,000) square feet of lot area for each dwelling unit. (h) Distances Between Main Buildings on Same Lot: 20 feet. Sec. 11 -1321. General. The following specific regulations and the general rules set forth in Article 4 -A shall apply in all R -6 Districts, as delineated and described in the Zoning Map(s). It is intended that this district classification be applied in areas where one and two - family homes and a mix of professional office, institutional and tourist - oriented uses may be located to promote low density residential standards and a mix of more intense business uses. Sec. 11 -1324. Minimum Height, Bulk and Space Requirements. (a) Lot Area: Not less than five thousand (5,000) square feet in all lots recorded on and after the effective date of this Chapter, August 1, 1958. However, regardless of date of recordation, there shall be not less than five hundred (500) square feet of lot area for each dwelling unit, and not less than three hundred fifty (350) square feet of lot area for each bedroom in a hotel, rooming or boarding house, residence club or motel. Section 7. The Alameda Municipal Code is hereby amended by amending the first paragraph of Section 11 -14D2 of Article 4 of Chapter 1 of Title XI thereof to read: 5 Sec. 11-14D2. Permitted Conversions. The conversion of an existing residential unit or units to multiple family dwelling units is permitted when the conversion meets the requirements of: Section 8. This ordinance shall be in full force and effect from and after the expiration of thirty (30)days from the date of its final passage. Section 9.
