AMENDING TITLE V, SECTION 5-152, OF THE ALAMEDA
MUNICIPAL CODE; SECTION 4 OF ORDINANCE NO 2250 N.S.;
AND SECTION 304(e)2 OF THE UNIFORM BUILDING CODE
PROVIDING QUADRUPLE PENALTIES FOR WORKING WITHOUT
PERMITS
BE IT ORDAINED by the Council of the City of Alameda that:
Section 1. The Alameda Municipal Code is hereby amended by
amending Subsection (b) of Section 5-152 (Permit) thereof to read:
(b) Permit Fee and Penalty.
(1) Prior to and as a condition of the issuance of
a permit under the terms of this Chapter, the
applicant shall pay a sum of Ten Dollars
($10.00) per address for which a permit is
issued.
(2) Where work is started without a permit, the
applicant shall pay an additional penalty fee
of $40.00 per address for which a permit is
issued.
Section 2. Section 4 of Ordinance No. 2250 N.S. is hereby
amended thereof to read:
Section 4. Penalties.
It shall be unlawful for any person, firm, or
corporation to install, alter, repair, relocate, add to,
replace, use or maintain plumbing or drainage systems in
the jurisdiction, or cause the same to be done, contrary
to or in violation of any of the provisions of this Code.
Maintenance of systems which were unlawful at the time
installed and which would be unlawful under this Code if
installed after the effective date of this Code, shall
constitute a continuing violation of the Code.
Any person, firm or corporation violating any
provisions of this Code shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be
punishable by a fine as established by the Alameda
Municipal Code for misdemeanors and infractions. Each
separate day or any portion thereof during which any
violation of this Code occurs or continues shall be

deemed to constitute a separate offense, and upon
conviction thereof shall be punishable as herein
provided.
Any person who shall commence any plumbing work for
which a permit is required by this Article without first
having obtained a permit therefor shall, if subsequently
permitted to obtain a permit, pay Ten Dollars ($10.00)
plus quadruple the permit fee fixed by this Article for
such work; provided, however, that this provision shall
not apply to emergency work when it is proved to the
satisfaction of the Plumbing Inspector that such work was
not practical to obtain a permit therefor before the
commencement of the work. In all such cases a permit
must be obtained as soon as it is practicable to do so,
and if there is any unreasonable delay in obtaining such
permit, Ten Dollars ($10.00) plus a quadruple fee as
herein provided shall be charged.
Section 3. The Uniform Building Code is hereby amended by
amending Section 304(e)2 of Ordinance No. 2265 N.S. thereof to read:
2. FEE. An investigation fee, in addition to the
permit fee, shall be collected whether or not a permit is
then or subsequently issued. The investigation fee shall
be quadruple to the amount of the permit fee required by
this code. The minimum investigation fee shall be the
same as the minimum fee set forth in Table No. 3-A. The
payment of such investigation fee shall not exempt any
person from compliance with all other provisions of the
code nor from any penalty prescribed by law.
Section 4. This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.
