EXTENDING INTERIM ORDINANCE NO. 2390 N.S.,
PROHIBITING AND SUSPENDING ISSUANCE OF BUILDING
PERMITS FOR CONSTRUCTION ON CERTAIN PROPERTIES
LOCATED ON THE WESTERLY SIDE OF PARK AVENUE
BETWEEN ENCINAL AVENUE AND CENTRAL AVENUE, THAT
ARE INCONSISTENT WITH PROPOSED ZONING
WHEREAS, the Council of the City of Alameda adopted
Interim Ordinance No, 2390 N.S. on June 7, 1988; and
WHEREAS, Interim Ordinance No. 2390 N.S. will expire on
July 22, 1988;
that:
BE IT ORDAINED by the Council of the City of Alameda
Section 1. From and after the effective date of this
ordinance, Interim Ordinance No. 2390 N.S. declaring that there
shall be no building permits issued by the City which may be in
conflict with any uses in an R-4 District for the properties
located within the C-2 District along the westerly side of Park
Avenue between Encinal Avenue and Central Avenue shall be
extended for approximately six months, through December 31, 1988.
Section 2. This ordinance is one of great necessity and
urgency within the meaning of Section 3-12 of the City Charter
and Section 65858 of the California Government Code, is
introduced and passed at the same Council meeting, and shall
become effective on July 20, 1988.
Section 3. The facts constituting the necessity and
urgency hereof are:
(1) Consideration of rezoning the subject area to
residential zoning has been initiated.
(2) Building permits could be issued prior to the
time the Planning Board has to consider the rezoning.
(3) If building permits are issued, the rezoning will be
ineffective.
(4) Development of this area inconsistent with Ordinance
2390 N.S. is a threat to the public welfare.

Section 4. This Council hereby finds, determines and
declares that it is in the best public interest and necessity
that this ordinance be introduced and passed at the regular
meeting of the City Council held July 19, 1988, and that this
ordinance become and be in full force and effect on July 20,
1988.
