Ordinance 1368Ordinances Ordinance No. 1368 New Series CITY OF ALAMEDA New Series AN ORDINANCE AMENDING CER-T AIN PORTIONS OF THE ALA- MEDA MUNICIPAL CODE RELAT-ING TO SUBDIVISIONS (SEC- TIONS 11-315 AND 11-319). BE IT ORDAINED BY THE COUN-CIL OF THE CITY OF ALAMEDA: Section 1. Section 11-315(c) and (d) of the Alameda Municipal Code arehereby amended to read as follows: Sec. 11-315(c). "Subdivider" shallmean any individual, firm , asso- ciation , syndicate , copartnership, corporation, trust or any otherlegal entity commencing proceed.ings under tohis ordinance to ef- fect a subdivision or division ofland hereunder for himself or foranother, Sec. 11-315(d). "Subdivision " re-fers to any real property, lm-proved or unimproved, or portionthereof, shown on the latestadopted county tax roll as a unitor contiguous units, which is di. vided for the purpose of sale C1lease, whether immediate or fu-ture, by any subdivider into two(2) or more parcels; provided, that this chapter shall not applyto the leasing of apartments, d-fices, stores, or similar apacewitohin an apartment building, industrial building, or commer-cial buildmg, nor shall ths chap- ter apply to mineral, oil or gas leases. Section 2. A new Section 11-315(1 is hereby added to the AlamedaMunicipal Code, which shall read as follows: Sec. 11-315(i). "Division of land"shall mean a subdivision of landresulting in the creation of four (4) or less parcels. Section 3. A new Section 11-319. is hereby added to the Alameda Municipal Code , which shall read as follows: Sec. 11-319.1. The Tentative Map of the division of land into four(4) or less parcels shall show the data required for subdivisions,except that in cases where street construction, improvement,widening or dedications or reser- vations for pUblic purposes arerequired, the Planning Board shall accept a Property DivisionMap showing the lot design anddimensions and information re- quired by the City Engineer' inlieu of a Tentative Map, and theCity Council shall permit the re-cording of an approved Property Division Map in lieu of a FinalMap in such cases; provided,however, in the event street con-struction, Improving or widen- ing, dedication, or reservations for public purposes are required,bhe Planning Board may give conditional approval to a Proper-ty Division Map presented underthis section, said approval beingconditioned by and contingent upon the construction of anystreet, or the improving or widen- ing thereof as required by thePlanning Board, and the requis- ite offering for dedication orreservation of the same for pub-lic purposes; or upon the execu- tion by the person, firm or corpo- ration seeking to file the Prop-erty Division Map of an agree-ment substantially in conform- ance with Section 11-3133 of this Code, together with the fiingof the bond required in said sec-tion; IneiHleI' case the:planningBoard may set time limitationswithin which the street construc- tion, improving, dedications orreservations for public use mustbe accomplished; provided, furth-er, that any division of landwhich results in the creation offour (4) or Jess parcels, alJ of which are incapable of beingused as lots as defined herein shalJ not require the submission of such Property Division Map. In lieu tohereof a map in a form acceptable to the City Engineerand City Planning Director of theCity of Alameda shall be sub-mitted and approved jointly bysaid Engineer and Planning Di-rector if found to be in compli- ance with the zoning and sub-division laws of the City ofAlamedaSection 4. The final paragraph of Section 11-319 of the Alameda Mu- nicipal Code . commencing with thewords "The Tentative Map of the (:Ii visioni .. of. . . ul1it. . .. .aJ1 cl..el1dillg with the words " . . . or reservationsfor public use must be accomplished is hereby repealed in its entirety.Section 5. This ordinance shall bein full force and effect from and after the expiration of thirty (30) days from the date of its finalpassage.FRNZ S.
