AMENDING THE ALAMEDA MUNICIPAL CODE
BY AMENDING SUBSECTION 21-2 (COLLECTION AND REMOVAL)
OF CHAPTER XXI (GARBAGE AND REFUSE)
ARTICLE 1 (REFUSE GENERALLY), AND
ADDING SUBSECTIONS 21-3.3 AND 21-3.4 TO
SUBSECTION 21-3 (PROHIBITED ACTS)
BE IT ORDAINED by the Council of the City of Alamedathat:
Section 1 The Alameda Municipal Code is hereby amended
by amending Subsection 21-2 (Collection and Removal) of Chapter XXI
(Garbage and Refuse), Article 1 (Refuse Generally) thereof , to read
as follows:
21-2.Rates for Collection
Collection of Surcharge.
in City of Alameda;Method
For the services of collection and disposal of garbage
and refuse , as herein provided for in the City of Alameda , there
shall be charged by the scavenger and collected by him/her from the
persons enumerated in subsection 21-2.2 hereof, rates as set by
City Council resolution. The method and amount of surcharge fee
shall be set by City Council resolution.
21-2.Rates for Col.lection on Department of Defense Property;
Method of Collection.
For services of collection and disposal of garbage andrefuse, on Department of Defense property, the Department of
Defense shall select a scavenger in compliance with federal rules
and regulations and set the rates to be charged by the scavenger.
The scavenger for the Department of Defense shall pay to the city
a garbage fee as set by City Council resolution. For the purpose
of this section Department of Defense property shall be defined to
include all property which the Department of Defense owns
operates , or controls through its various agencies.
21-2.Obstructing Scavenger a Misdemeanor.
It shall be deemed a misdemeanor for any person, their
agents or employees , to hinder , threaten, or impede , or obstructany licensed scavenger in the performance of his/her duty
def ined in this chapter.
21-2.Further Regulations Authorized.
The Health Officer is hereby empowered to make such
further regulations pertaining to the city of Alameda as will be
necessary to carry out the intent and purposes of this chapter.
21-2.10 Officers to Enforce Section; Right to Enter Premises;Obstructing Entry.
All members of the Police Department and the City Manager
or his/her designee are hereby specifically required to enforce the
provisions of this chapter , and shall have the right to enter any
and all premises in the City of Alameda for the purpose of
ascertaining as to the sanitary condition thereof , and any person
denying or obstructing such entry shall be subject to the penalty
herein provided.
section The Alameda Municipal Code is hereby amended
by adding Subsections 21-3.3 and 21-3.4 to section 21-3 (Prohibited
Acts) of Chapter XXI (Garbage and Refuse) thereof , to read as
follows:
21-3.Deposi of Refuse in street Litter Cans. No person shall
deposit or cause to be deposited in a street litter can anyrubbish, garbage , offal , f il th or other refuse matter which may be
generated from a personal household or a business.
21-3.Deposi of Refuse in city Facility Garbage Dumpsters.
No person shall deposi or cause to be deposited in a City Facility
garbage dumpster any rubbish, garbage , offal, f il th or other refusematter which may be generated from a personal household or abusiness.
section This ord lDdDce shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.
