AMENDING THE ALAEDA MUNICIPAL CODE BY AMENDING SECTION 2-13
ABOLISHING THE CABLE TELEVISION OVERSIGHT COMMITTEE, AND
ESTABLISHING THE CABLE TELEVISION ADVISORY COMMITTEE AND
PRESCRIBING MEMBERSHIP AND DUTIES OF SAID COMMITTEE.
BE IT ORDAINED by the Council of the City of Alameda that:
section 1. The Alameda Municipal code is hereby amended by
amending Subsection 2-13 (Cable Television Oversight Committee) byestablishing the Cable Television Advisory Committee and
Prescribing Membership and Duties to said Committee thereof to
read:
2-13 CABLE TELEVISION ADVISORY COMMITTEE.
2-13.ESTABLISHED. The Cable Television Oversight Committeeof the ci cy of Alameda is hereby abolished and in its place is
established the Cable Television Advisory Committee , which shall
consist of five (5) members who shall be nominated by the Mayor and
appointed by the City council from among the qualified electors ofthe City. Four of the members shall be appointed at-large, while
one member shall be appointed from City staff who will act as theCity representative.
2-13.TERM OF OFFICE. Except as set forth below, the term
of office of the members of the Committee shall be for four (4)
years and shall end on June 30th of the year the terms are due to
expire. Members may serve two (2) full terms. The terms of office
for the members of the Cable Television oversight Committee first
appointed shall commence on the effective date of this Ordinance.
The two at-large members who served on the former Cable Television
Oversight Committee shall serve initial terms ending June 30, 1995.
The other at-large members shall serve initial terms ending June
, 1997. The term of office for the member appointed from City
staff shall be at the discretion of the City Council.
2-13.QUALIFICATIONS. One of the at-large Committee members
shall have a background in business and finance or other financial
proformas and conducting financial statement analysis. One of the
at-large members shall have experience in cable television withparticular emphasis in local origination and public access
programming. One of the at-large members shall have expertise in
youth and minority interests. One of the at-large members shall
have expertise in consumer affairs. Commi ttee members should
attend annually at least one seminar, conference , meeting or FCC
briefing to assure that the City is kept informed and made
knowledgeable about cable industry developments , FCC regulations
and new Federal legislation.
2-13.VACANCY-REMOVAL. Any member may be removed bymajority vote of the city Council. If a vacancy occurs other than
by expiration of the term vacancies shall be filled by appointmentof the City Council and shall be for the unexpired portion of the
term of office vacated.
2-13.5 MEETINGS-QUORUM-OFFICERS.
Advisory Committee shall:The Cable Television
( a)Hold regular meetings at least once every three (3)
months and at the discretion of the Committee , shall hold
other meetings as may be necessary or expedient. Three
members of the Committee shall constitute a quorum for
the purpose of transacting the business of the Committee.
(b)The Committee shall elect a Chairperson and Vice
Chairperson, both of whom shall serve at the pleasure of
the Committee. The term of office shall be for one (1)year.
2-13.RECORDS. A City staff member other than the Committee
Member shall act as secretary of the Committee and shall be
responsible for the keeping of records of all proceedingsfindings, determinations , and transactions of the Committee which
records shall be public record and a copy of which shall be filed
with the City Clerk.
2-13.7 DUTIES , POWERS , AND RESPONSIBILITIES. The Cable
Television Advisory Committee shall have the following dutiespowersand responsibi 1 ities and such others as it may beintrusted with by the City Council from time to time. The

Be advisory to the City Council
Moni tor the cable company I s operations to assurecontinued compliance with all terms , conditions , and
provisions of the franchise agreement.
Evaluate the cable company I s overall performance annually
and submit that information with recommendations in a
written report to the city Council.
Review and advise the Council on all new technologies
which might have an effect on cable operations in the
Ci ty of Alameda.
Review all Federal and State legislation dealing with
cable television operations and make recommendations to
the City Council as appropriate.
(f)Review and make recommendations to the City Council all
the cable company I s policies and operations which might
adversely effect consumer interest of the City
Alameda.
(g)
Provide the cable company with recommendations on its
public access and local origination programming.
It is the intent of this section that individual subscriber
complaints shall not be heard by the Committee until all other
administrative remedies have been thoroughly exhausted such
complaints first being directed to the cable operator and if
unresolved at that level , then to City staff. Such individualsubscriber complaints would reach the Committee only if not
resolved at an earlier administrative level.
2-13.BUDGET. Staff time and Committee expenses associated
wi th the Cable Television Advisory Committee shall be paid out of
the annual franchise fees.
section 2. This ordinance shall be in full force and effect
from and after the expiration of thirty (30) days from the date of
its final passage.
