Ordinance 2633CITY OF ALAEDA ORDINANCE NO. 2633 New Series AMENDING THE ALAEDA MUNICIPAL CODE AMENDING CERTAIN SECTIONS OF ARTICLE V (ADMINISTRATIVE POLICIES AND PROCEDURES),CHAPTER II (ADMINISTRATION) THEREOF PERTAINING TO DISPOSITION AND SALE UNCLAIMED PROPERTY , AND CHAPTER XI (BICYCLES)THEREOF, PERTAINING TO DISPOSITION UNCLAIMED BICYCLES that:BE IT ORDAINED by the Council of the City of Alameda Section 1 The Alameda Municipal Code is hereby amendedby amending Subsection 2-63.(Duty to Report Property in Possession) of Article V (Administrative Policies and Procedures) Chapter II (Administration) thereof to read as follows: 2-63.Duty to Report Property in Possession. The Chief of Police and the Superintendent of Streetsshall, at the expiration of each fiscal year , make a report to the Council of all lost , stolen , and unclaimed property which may be in his/her possession or under his/her control, and within thirty (30) days after the date of such report he/she shall turn over to the ';nance Director of the City of Alameda all property and money mentioned in such report, and take his/her receipt therefor. Section 2 The Alameda Municipal Code is hereby amendedby amending Subsection 2-63.(Sale by City Purchasing Agent of Property in His/Her Possession) of Article V (Administrative Policies and Procedures), Chapter II (Administration) thereof toread as follows: 2-63.Sale by City Finance Director of Propert in His/HerPossession. The City Finance Director , or his/her designee , shallfrom time to time sell all unclaimed property in his/herpossession, unless such property is to be retained by the City for a public use pursuant to subsection 2-63.10. Notice of such sales shall be published for ten (10) days prior to the time of sale the official newspaper of the City, which notices shall specify the time and place of sale and briefly describe the property to besold. When the name and address of the owner of any unclaimed property is known to the Finance Director , or his/her designee he/she shall also mail a notice of such sale to said owner at leastfive (5) days before the time of sale. If for any reason any of the property is not sold at the time set for the sale , the sale thereof may be postponed from day to day for a period of time not longer than ten (10) days. In case of postponement notice thereof shall be posted at the place of sale. section The Alameda Municipal Code is hereby amended by amending Subsection 2-63.6 (Conduct of Sale; Auction) of Article(Administrative Policies and procedures) , Chapter II (Administration) thereof to read as follows: 2-63.Conduct of Sale; Auction. After having duly published the advertisement provided for by the last subsection , the City Finance Director , or his/herdesignee, shall at the time and place designated in theadvertisement, proceed to sell at auction , to the highest bidder, for lawful money, the property described in said advertisement and after having paid the just and reasonable expenses for storage, advertising, and sale, shall keep the proceeds for one year ,subj ect to any lawful claim which may be made by the owner ofany property sold. section 4 . The Alameda Municipal Code is hereby amended by amending Subsection 2-63.7 (Disposition of Proceeds) of Article(Administrative Policies and Procedures) , Chapter II (Administration) thereof to read as follows: 2-63.Disposi tion of Proceeds. The City Finance Director , or his/her designee , shall , atthe expiration of one (1) year after every sale hereunder made , pay into the General Fund all moneys remaining in his/her hands onaccount of such sale. section 5 . The Alameda Municipal Code is hereby amended by amending Subsection 2-63.8 (Deduction of Costs and Charges) ofArticle V (Administrative Policies and Procedures), Chapter II (Administration) thereof to read as follows: 2-63.Deduction of Costs and Charges. Upon the payment of the proceeds of the sale of any property to the person entitled thereto , the City Finance Director, or his/her designee , shall deduct from the amount of such proceedsthe just proportional share of the expenses of storage advertisement , and sale. section 6 . The Alameda Municipal Code is hereby amended by adding Subsection 2-63.10 (Retention for Public Use) to Article(Administrative Policies and Procedures) , Chapter II (Administration) thereof to read as follows: 2-63.Retention for Public Use. If the City Finance Director, or his/her designee determines that any such property transferred to him/her for sale is needed for a public use , such property may be retained by the Ci ty and need not be sold. section 7 The Alameda Municipal Code is hereby amendedby amending Subsection 11-8.(Public Auction) of Chapter II (Bicycles) thereof to read as follows: 11-8.Public Auction. All abandoned bicycles and unidentified bicycles remaining in the hands of the Chief of Police may, at the end ofthree (3) months , be sold at public auction or retained for public use in the manner provided for in Section 2-63 of this Code for the disposition and sale of other lost and unclaimed property. ection This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
