AMENDING THE ALAMEDA MUNICIPAL CODE
BY AMENDING SUBSECTION 10-2.
OF SECTION 10-2 (PERMITS) AND
SUBSECTIONS 10-5., 10-5.2 AND 10-5.
OF SECTION 10-5 (TAXICABS), CHAPTER X (TAXICABS
AND VEHICLES FOR HIRE), THEREOF
PERTAINING TO OPERATION OF TAXICABS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAEDAthat:
Section 1 The Alameda Municipal Code is hereby amended
by amending Subsection 10-2.1 (Owner's Permit to Operate Public
Motor Vehicle) of section 10-2 , (Permits), Chapter X (Taxicabs and
Vehicles for Hire), thereof to read:
10-2 PERMITS.
10-2.Owner s Permit to Operate Public Motor Vehicle.
Except for 1:axicabs which are subject to the franchise
requirements of section 10-5 of this Code , it shall be unlawful to
operate any public motor vehicle in the CiL:Y unless the owner
thereof shall apply for and obtain , a permit to do so , which
permit shall be applied for , granted and in existence , all
compliance with the provisions of section 5-16 of this Code. The
application for such owner's permit shall set forth in addition to
the requirements specified in subsection 5-16.2 of this Code , the
number of vehicles proposed to be operated , a complete description
of the vehicles proposed to be operated and of the proposedoperations, together with the initial rates to be charged therefor.
In addition thereto , every application for an owner's permit to
operate a motor bus shall set forth , in full, the proposed route
and schedules , and every application for an owner's permit to
operate a taxicab shall set forth , in full , the color scheme and
characteristic insignia to be used to designate the vehicles of theowner. Such applications for an owner's permit shall also be
accompanied by a sworn financial statement of the applicant.
section 2 The Alameda Municipal Code is hereby amended
by amending Subsection 10-5.(Taxicab Permit Fees Standards of
Maintenance and Annual Inspection), 10-5.(Radio Dispatch), and
10-5.3 (Taximeter), thereof to read:
10-5.Franchise Required.
No taxicab shall seek or accept passengers within the City
unless said taxicab has applied for and obtained a franchise fromthe City. Rules and Regulations of taxicab franchises areestablished by ordinance. The fees for taxicab franchises shall be
established by resolution of the City Council.
10-5.Dispatch.
Each franchise shall provide a twenty-four (24) hour dispatch
service for the franchise's drivers. Regular franchises shall
provide dispatch services by two-way radio. Cellular telephones
may only be used as an addition to a regular franchise's dispatch.
Associate franchises may provide dispatch services by either two-
way radio or cellular telephone. Franchisees may dispatch taxicabs
by two-way radio or by cellular telephone. Each taxicab shall be
equipped with the appropriate equipment to receive the dispatches.
10-5.Franchise Requirements.
No franchise granted pursuant to the taxicab
ordinance shall be for longer than five (5) years.

In addition to the business license and driver'permit
requirements set forth elsewhere in this Code , all franchises are
required to comply with the "Standards for Taxicab Maintenance"
promulgated by the Chief of Police and filed with the City Clerk.All taxicabs shall be inspected by the Police Departm nt and mustpass such inspection.
section 3 This ordinance shall be in full force and effect
from and after the expiration of thirty (30) days from the
