BEITORDAINEDbytheCounciloftheCityofAlamedathat: Section1.TheAlamedaMunicipalCodeishereby amendedbyamendingsUbsection5-2.2(SeparateLicenseforEach PlaceofBusiness)ofsection5-2(LicenseRequired),ChapterV (LicensesandPermits),thereoftoread: a.Aseparatelicensemustbeobtainedforeachand everybranchestablishmentorseparateplaceofbusinessinwhich abusinessisconducted,exceptabranchestablishmentoperatedby apersonlicensedunderSUbsection5-4.1pofthiscode,inwhich caseaduplicatelicenseforeachbranchestablishmentshallbe issuedforafeesetbyCityCouncilresolutionforeachsuch place;provided,thatwarehousesandstorageplantsusedin connectionwithandincidentaltoabusinesslicensesunderthe provisionsofthischaptershallnotbedeemedtobeseparate placesofbusinessorbranchestablishments. b.Intheeventany'businessmaybecategorizedasa separateandclearlydefinedadministrativeheadquartersandasone ormoreofthecategoriessetforthinSection5-4.1atanyfixed placeofbusiness,theLicenseCollectorshallreasonablyand fairlyallocateandapportionthetaxesowedunderthisChapter betweentheoramongthecategories.TheLicenseCollectoris auth~rizedtoestablishreasonableregulationsandproceduresto establishareasonableandfairallocationbetweensuchcategories. Section2.TheAlamedaMunicipalCodeisherebyamen~~d byamendingSUbsection5-2.6(LicenseforLessThanFullPeriod)of Section5-2(LicenseRequired),ChapterV(LicensesandPermits),thereoftoread: 5-2.6 LicenseforLessThanFullPeriod. Exceptashereinotherwiseprovided,whenanybusiness requiredhereintopayanannualorquarterlylicensefeeshall commencetodobusinessafterthebeginningofthecurrentannual orquarterlylicenseterm,suchlicenseshallbeissued.fora periodexpiringonthelastdayofthecurrentlicensetermin whichthesameisissuedandthelicensefeeshallbeanamount whichbearsthesameproportiontothelicensefeeforthefull termasthenumberofmonthsremaininginsuchterm,includingthe monthinwhichsuchlicenseisissued,bearstothetotalnumberof monthsinthefullterm,providedtheamountisnot·lessthanthe amountsetbycityCouncilresolution. section3.TheAlamedaMunicipalCodeisherebyamended byaddingsubsection5-2.7(EvidenceofDoingBusiness),ofsection 5-2(LicenseRequired)toChapterV(LicensesandPermits),thereof toread: 5-2.7 EvidenceofDoingBusiness. Whereanyperson,byuseofadvertisingmediums, includingbutnotlimitedtoradio,television,signs,circulars, cards,telephonebooks,ornewspapers,shalladvertise,holdout, orrepresentthathe/sheisinbusinessintheCity,orwhenany personholdsanactivelicenseorpermitissuedbyagovernmental agencyindicatingthathe/sheisinbusinessintheCity,orwhen anypersonmakesasale,takesanorder,rendersacommercial service,orperformsanyothersimilaractwithintheCity,then suchfactsshallbeconsideredprimafacieevidencethathe/sheis conductingabusinessintheCity. section4.TheAlamedaMunicipalCodeisherebyamended byamendingsubsections5-3.8(TransferofLicense;Procedure)and 5-3.10(LostLicense)ofsection5-3(Application:Formand Issuance),ChapterV(LicensesandPermits),thereoftoread: 5-3.8 TransferofLicense;Procedure. Nolicenseorvehiclestickergrantedorissuedunderany provisionsofthischaptershallbeinanymannertransferredor assigned,orauthorizeanypersonotherthanthepersonnamedin thelicensetocarryonthebusinessthereinnamedortotransact suchbusinessinanyplaceotherthantheplaceorlocationtherein namedwithoutthewrittenconsentoftheBureauofLicenses endorsedthereon.Atthetimesuchlicenseisassignedor transferredortheplaceforthecarryingonofsuchbusinessis changed,thepersonapplyingforsuchtransferorchargeshallpay totheBureauofLicensesafeeforeachassignmentortransfer. TheassignmentortransferfeeshallbesetbyCityCouncil resolution. 5-3.10 LostLicense. TheBureauofLicensesshallchargeforeachduplicate licenseorduplicatevehiclestickerissuedtoreplaceanylicense orvehiclestickerissuedundertheprovisionsofthischapter whichhasbeenlostordestroyed;theapplicantshallmake satisfactoryproofofsuchloss.Thefeeforalostlicenseshall besetbyCityCouncilresolution. section5.TheAlamedaMunicipalCodeisherebyamended byadding5-3.11(NoBillRequired)tosection5-3(Application: FormandIssuance),ChapterV(LicensesandPermits),thereofto read: 5-3.11 NoBillRequired~ Notwithstandingsubsection5-3.4hereintothecontrary, neithertheBureauofLicensesoranyotherCityofficialis requiredtosendorgiveanynoticeorbilltoanypersonsubject totheprovisionsofthischapter,andfailuretosendsuchnotice orbillshallnotaffectthevalidityofanylicenseorpenalty leviedpursuanttotheprovisionsofthischapter. section6.TheAlamedaMunicipalCodeisherebyamended byamendingsubsection5-4.2(MinimumTax)ofsection5-4(License Fees),ChapterV(LicensesandPermits),thereoftoread: 5-4.2 MinimumTax. Thefeerequiredundersubsection5-4.1for administrativeheadquarters,autodealersandgrocers,bowling alley,billiardorpoolroom,businessandprofessionalservices, fleamarkets~gene~alandspecialtycontractors,junkcollectors, manufacturing,non-residentialpropertyrental,retailingand wholesaling,professional,semiprofessional;connectedbusiness, televisionsUbscriptionservice,theatersanddrive-insand transportationofpersonsandgoodsshallbesetbyCityCouncil resolution.Thefeerequiredunderthissubsectionforresidential propertyrentalshallbesetbyCityCouncilresolution. _TheMinimumTaxwillbeadjustedeachfiscalyearbythe percentagechangeintheConsumerPriceIndex(UrbanWageEarners andClericalWorkers,SanFrancisco-OaklandArea,Februarydata) adjustedtothenearestwholedollar. section7.TheAlamedaMunicipalCodeisherebyamended byamendingsubsection5-5.2(Veterans)ofsection5-5 (Exemptions),ChapterV(LicensesandPermits)thereoftoread: 5-5.2Everypeddler,solicitororotherpersonclaimingtobe entitledtoexemptionfromthepaymentofanylicenseprovidedfor inthischapteruponthegroundthatheisanhonorablydischarged orreleasedsoldier,sailorormarineoftheUnitedstateswhois physicallyunabletoobtainalivelihoodbymanuallaborandwhois avoterofthestateofCalifornia,asprovidedorhereaftertobe providedbysection16001oftheBusinessandProfessionsCodeor otherlawofthisstate,(hereinafter"disabledveteran"shall,in additiontotheinformationrequiredinsubsection5-5.1hereof, alsofilewiththeBureauacertificateofaregularlylicensedand practicingphysiciandatedwithinamonthoftheapplication,to theeffectthattheapplicantisphysicallyunabletoobtaina livelihoodbymanuallabor,andstatingthenatureofthe incapacitation.TheprovisionsofSection16001oftheBusiness andProfessionsCodeofthestateofCaliforniaareherebymade applicabletotheCityofAlameda,andtheprovisionsofthe sectionofthecodeareherebymadeapplicable,underthesame conditionsandlimitations,toanyhonorabledischargedorreleased solider,sailorormarineoftheunitedStateswhoservedorshall serveinanywarinwhich'theunitedstateshasbeenormaybe engaged.Withoutlimitingtheforegoing,disabledveteransare exemptedfrompayingthelicensefeesetforthinsection5-2of thischapter. Section 8.TheAlamedaMunicipalCodeishereby amendedbyamendingsubsection5-7.2(LicenseaDebt)ofsUbsection 5-7(Enforcement;Penalties;Refunds)ofChapterV(Licensesand Permits),thereoftoread: 5-7.2 LicenseADebt. Theamountofanylicensefeeandpenaltyimposedbythe provisionsofthischaptershallbedeemedadebttotheCity;and anypersoncarryingonanybusinesswithoutfirsthavingprocured alicensefromtheCitytodososhallbeliabletoactioninthe nameoftheCity,inanycourtofcompetentjurisdiction,forthe affiountoflicense,penaltiesinterestandattorneys'fees. If'thefeesarenotpaidwhendue,suchfee,penaltyand interestshallconstituteanassessmentagainstthelicensee'sreal propertyandshallbealienonthepropertyintheamountthereof, whichliencontinueuntiltheamountthereofincludingall penaltiesandinterestarepaid,oruntilitisdischargedof record. section9.TheAlamedaMunicipalCodeisherebyamended byaddingsUbsection5-7.6(CollectionofDelinquentChargesand Fees)ofsUbsection5-7(Enforcement;Penalties;Refunds)of ChapterV(LicensesandPermits),thereoftoread: 5-7.6 CollectionOfDelinquentChargesAndFees. DuringMarchofeachyear,theLicenseCollectorshall submittotheCityCouncilareportofdelinquentchargesandfees. Atime,dateandplaceforhearingofthereportandanyobjections orproteststheretoshallbefixedbytheCityClerk.Notless thanten(10)dayspriortothedateofsuchhearing,theFinance Directorshallmailwrittennoticethereoftotheownerofeachof thepremisesaffectedthereby,usingforthispurposethenamesand addresseswhichappearonthelastequalizedtaxassessmentroll. (a)AtsaidhearingtheCityCouncilshallhearany objectionsorprotestsofownersofpremisesliable tobeassessedfordelinquentchargesoffees.The CityCouncilmaymakesuchrevisionsorcorrections tothereportasitdeemsjust,afterwhichthe reportshallbeconfirmedbyresolution.The delinquentchargesandfeessetforthinthereport asconfirmedshallconstitutespecialassessments againsttherespectivepremisesandarealienon thepremisesfortheamountsofsuchdelinquent chargesandfees. (b)PriortoAugust10,acertifiedcopyofthe confirmedreportshallbefiledwiththecounty Auditor,who.shallentereachassessmentonthetax rollagainsttherespectivepremises.Said assessmentshallbecollectedat"thesametimein thesamemannerasordinarymunicipaladvalorem taxesandshallbesubjecttothesamepenalties andthesameprocedureandsaleincaseof delinquencyasprovidedforsuchtaxes.Alllaws applicabletothelevy,collectionandenforcement ofmunicipaladvalorempropertytaxesshallbe applicabletosuchassessments. (c)Theliencreatedattachesuponrecordationofa certifiedcopyoftheconfirmedreportinthe officeoftheCountyRecorderandshallcontinue untilthechargesandfeesarefullypaid. Section10.TheCityCounciloftheCityofAlamedahas determinedthatthisOrdinanceisstatutorilyexemptunder CaliforniatnvironmentalQualityActGuidelinessection15273 (Rates,Tolls,Fares,Charges)becauseitrelatestotheapproval ofchargesforthepurposeofmeetingoperatingexpenses. Section11.ThisOrdinanceshallbeinfullforceand effectiveimmediatelyfollowingitsfinalpassagepersection3-12 oftheCityCharter.
