Ordinance 2656CITY OF ALAEDA ORDINANCE NO. New Series 2656 AUTHORIZING GRANT OF ACCESS EASEMENT TO PETER R. AND TRIJNTJE KLUITENBERG ON THE PROPERTY ADJACENT TO 211 BEACH ROAD WHEREAS , in 1953 a permit was issued by the City Alameda and a garage was constructed at the rear of the property known as 211 Beach Road; and WHEREAS , access to this garage has been across a 10-foot wide strip of land owned by the City of Alameda; and WHEREAS , Peter R. and Trijntje Kluitenberg has agreed to pay the fair market value , which was based on tpe Alameda CountyAssessor's land appraisal of the 211 Beach Road property, for said easement in the amount of $5200. WHEREAS , the City Council of the City of Alameda hasdetermined that chis project is categorically exempt under theCalifornia Environmental Quality Act Guidelines section 15305(Minor Alterations in Land Use Limitations) subdivision (a) because it grants an easement. that:BE IT ORDAINED by the Council of the City of Alameda Section 1.The City of Alameda grants to Peter R. andTrijntje Kluitenberg for the sum of $5200 a 10-foot wide perpetualnon-exclusive easement for ingress and egress and for the use and maintenance pf an existing yard upon that certain real property inthe City of Alameda , County of Alameda , State of Californiadescribed as follows: A strip of land 10.00 feet in width , the south line of which is the northerly line of the parcel of landdescribed in the deed to Peter R. and Trijntje Kluitenberg 1987 rust recorded June 18 , 1987 , Series No. 87-172616 and further described as follows: BEGINNING at a point on the northeasterly line of Beach Road and the northerly line of the parcel of land deF!ribed in the deed to Peter R. and TrijntjeKlui tenberg; THENCE northwesterly along said northeasterly line ofBeach :Road 11.97 feet more or less to a line parallel to and 10 feet from the northerly line said parcel; THENCE easterly along the said parallel line 131.65 feet to a point on the prolongation of the northeasterly property line of said parcel; THENCE southeasterly along the said prolongation of thenortheasterly property line , being a line parallel with the northeasterly line of Beach Road 11. feet more or less to the northerly line of said parcel thence westerly along said northerly line said parcel to the point of BEGINNING. section The Mayor and the City Clerk be , and eachhereby is , authorized and directed to execute and to attest to respectively, on behalf of the City of Alameda , a grant of said easement to Peter R. and Trijntje Kluitenbe.rg.
